J40/10813/2010, bank account RO71CITI0000000724652158, (here in after referred to as "Nespresso Division") notifies its clients/ potential clients about the terms and conditions of the "Nespresso Autumn in partner stores".

The promotion involves giving a discount for Nespresso coffee capsules when purchasing a Nespresso coffee machine included in the promotion from partner stores, between September 3rd 2024, 09:00 – November 3rd, 2024, 09:00.

Coffee machines from the Original system included in the promotion: Essenza Mini, Inissia, Pixie, Citiz, Citiz&Milk, Lattissima One, Atelier or Gran Lattissima.

Coffee machines from the Vertuo system included in the promotion: Nespresso Vertuo Pop, Vertuo Next and Vertuo Lattissima.

The discount for the purchase of Nespresso coffee capsules can be claimed no later than 21 days from the date of purchase of the coffee machine, depending on the model of the coffee machine and according to the procedure set out below:

Conditions for granting the discount:

VERTUO:

Receive a discount of 150 RON (VAT included) for Nespresso Vertuo coffee capsules when purchasing a Vertuo Pop, Vertuo Next or Vertuo Lattissima coffee machine.

ORIGINAL:

Receive a discount of 150 RON (VAT included) for Nespresso Original coffee capsules when purchasing a Lattissima Touch, Nespresso Atelier, Gran Lattissima, Creatista Plus coffee machine;
Receive a discount of 130 RON (VAT included) for Nespresso Original coffee capsules when purchasing a CitiZ, Citiz&Milk, Lattissima One or Essenza Plus coffee machine;
Receive a discount of 100 RON (VAT included) for Nespresso Original coffee capsules when purchasing a Essenza Mini, Inissia, Pixie coffee machine.

The discount value can only be used for the purchase of Nespresso coffee capsules. This value cannot be transferred into the client's account and cannot be transformed in cash.

To benefit from the discount (including VAT):

After purchasing a Nespresso coffee machine from partner stores between September 3rd 2024, 09:00 – November 3rd, 2024, 09:00, access the promo.nespresso.ro platform;
Enter the tax documents proving the purchase, place a coffee order and fill in your details to register as a Nespresso member;
Select your favourite coffee varieties. The discount will be automatically applied to the value of the placed order;

To benefit from the promotion, place your order for coffee within 21 days from the date of purchase of your coffee machine.

*The discount can be applied both by ordering on the promo.nespresso.ro platform, ordering in the Nespresso Boutique or calling the Customer Relations Center at 0800 008 300. The discount will be granted based on the presentation of documents proving the purchase of the coffee machine during the promotional period from the partner stores.

In the context of this promotion, the notion of fiscal document represents the fiscal receipt or fiscal invoice that attests the purchase of a Nespresso coffee machine and that must have a date of issue during the promotion period.

The discount must be used only for one order. If the value of the order is under the limit of the discount of RON 100, RON 130, RON 150, the discount will not be applied, so please add coffee capsules with the discount value as minimum value. If the value of the coffee capsules purchased is higher than the discount value, you will pay the price difference.

During the promotion, one client can be granted a maximum number of 5 discounts, even if they purchase more than 5 coffee machines and regardless of the distribution channel from which the machines are purchased.

The Nespresso Member account provides you with quick access to news and information about our coffee varieties, promotions, as well as technical advice and assistance on how to use your machine: /ro/en/services.

Registration as member of the Nespresso entails that:

the client is the holder of a Nespresso coffee machine, regardless if this machine was purchased from Nestlé Romania S.R.L, Nespresso Division, Nespresso partner shops, Nespresso shops or from other countries or other sources;
the client registers as Nespresso member by filling in and signing a form for personal data (name, email address, phone number, mailing address);
the client purchases minimum one Nespresso coffee box (10 capsules).

For the purchase of the coffee machine between September 3rd 2024, 09:00 – November 3rd, 2024, 09:00, from partner stores (those mentioned above or mentioned on www.nespresso.com), the discount for Nespresso coffee capsules can be claimed no later than 21 days from the date of purchase of the coffee machine, as follows:

In Nespresso Boutique or in Nespresso points of sale: Show the original invoice or tax receipt, certifying the purchase of a coffee machine only from the Nespresso partner stores indicated above during the promotion period together with the sticker and the series of the purchased machine (this can be found on the drip tray of the coffee machine);
By means of the Client Service Centre: Send to Nespresso.romania@Nespresso.com a copy of the invoice or tax receipt attesting the purchase of a coffee machine only from the Nespresso partner shops indicated above during the promotion period, together with the identification data (name, surname, address, phone number, shop from which you purchased the device) and the sticker with the serial number of the purchased coffee machine (this is found on the drip tray of the coffee machine)
Documents can be sent in jpg or pdf format, the size of the message should not exceed 5 MB. The Customer Service Center analyses and validates the documents sent within 48 hours of their transmission (during the working hours displayed on the website www.nespresso.com), Then contact the Nespresso member who submitted the request within 24 hours to register the order in which the discount is used.

Nespresso is not responsible for the loss/ deterioration of the fiscal receipt or of the original invoice, if applicable.

The discount can be redeemed only in the country where the machine was purchased.

CONFIDENTIALITY AND PERSONAL DATA PROCESSING

Nespresso Division processes the personal data of the participants to this promotion according to the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (\"GDPR\") and the Information Note on the processing of personal data on the Nespresso.com website.
This promotion involves the acquisition of products and through online digital platforms and/ or applications that are not in the control of Nespresso, but of Flanco and eMag partners. These platforms and/ or online applications publish and use their own policies regarding the use and processing of personal data, the Participants having the obligation to inform themselves about them, Nespresso not having any responsibility in this regard towards the Participants who wish to benefit of the promotion presence.
The Nespresso Division guarantees the confidentiality of the personal data of all participants. The personal data indicated above are provided directly by you, and your refusal to provide this data results in the impossibility of Nestlé Romania SRL, its partners and/ or suppliers, to adequately fulfil its specific activities and its collaboration with you. The personal data is processed based on the legal obligation of the controller (art. 6 (1) (c) of GDPR), legitimate interests (art. 6 (1) (f) of GDPR) and/ or the consent of the data subject (art. 6 (1) (a) of GDPR).
The following data may be collected from all participants: name, surname, address, telephone number, e-mail address, Nespresso Member number, the name of the store where the device was purchased and the date of purchase. For the fulfilment of some tax obligations, Nespresso Division may request data such as your PIN.
By providing the personal data in the manner indicated expressly in the Terms and Conditions, the participants give their express and unequivocal consent that their personal data may be entered in the Nespresso Division database, exclusively for the discount registration, validation, allocation and the fulfilment of their legal and/ or tax obligations.
Nespresso Division takes all necessary measures to make sure that your personal data is processed only for the minimum necessary period for granting the discount and according to the Nespresso member conditions which are available at www.nespresso.com.
The personal data collected within this promotion will not be disclosed to third parties, except for the cases where the Nespresso Division must comply with obligations imposed by the law in force.
Nespresso Division may request the participants for their consent for further promotional and marketing notifications and to use their first and last name, free of charge, in various printed materials, audio and video. The participants will not be obliged to express their agreements, remaining at their free choice. If the participants shall desire to express their consent for this purpose, this will be noted by a written statement signed by them; the granting of the discounts is in no way conditioned by the option expressed on this matter.
According to the applicable law, data subjects benefit from the right to be informed, to have access to data, intervention and portability of personal data, the right not to be subject to an automatic individual decision, and to address the court and competent authorities. This promotion cannot be used at the same time as other promotional offers or discounts provided by the Nespresso Division. Nespresso Division reserves its right to refuse the attempts of using gift coupons which entail the breaching of this terms and conditions. In this respect, the Nespresso Division may request more information and additional documents.

The following categories of individuals cannot benefit from the " Nespresso Autumn in partner stores".

employees of Nestlé Romania S.R.L. and of its distributors;
employees of Nestlé Romania S.R.L., Nespresso Division partner shops;
employees whose companies are involved in the performance of any activities related to the organisation and operation of Nespresso;
relatives of the employees mentioned above (namely children/ parents, brothers/ sisters, spouses)

Can participate to the promotion:

natural persons with age over 18 on the date of commencing the Campaign, with domicile or residence, even temporary, in Romania.
legal persons with registered office in Romania.

Nespresso Division reserves its right to amend this document during the promotion deployment, but not before notifying the public on www.Nespresso.com website. In order to inform the public, the Terms and Conditions of the promotion will be published and will be available for free, to any interested person, on the www.nespresso.com website, Legal Mentions section, in Nespresso Boutique and in shops during the period of the campaign.

Any voucher/discount that you can benefit from within this promotional campaign can be used only once, in accordance with the terms and conditions of this campaign. Participants undertake not to use the discounts/vouchers/promotional codes that are subject to this campaign, applicable through the Nespresso website/account, for purposes contrary to the interests of Nespresso or other participants, and not to access/use these benefits in bad faith or in ways other than those permitted by Nespresso according to the terms and conditions. It will be interpreted as an attempt of fraud, including the abusive/malicious/bad faith or erroneous use of any promotional codes/vouchers/discounts applied as a result of technical errors in the electronic programs used by Nespresso. Any benefits obtained by participants/members in this manner (due to technical errors) will be considered undeserved, and their restitution/return/cancellation/invalidation will be required. If it is found that a participant/member has unjustifiably benefited from discounts/vouchers/promotional codes, etc., and/or is suspected of fraud, Nespresso reserves the right to (i) request clarifications and any relevant documents, (ii) invalidate all entries/orders that do not comply with which the participant has entered the Campaign, (iii) invalidate additional discounts that the participant has unjustifiably benefited from. Nespresso reserves the right to invalidate entries and/or orders placed or being placed and not to deliver products to those participants/members who directly or indirectly attempt to unjustifiably benefit from the discounts/vouchers/promotional codes that are subject to this Campaign.
