Personal Information that we “Share,” “Sell,” or Use for “Targeted Advertising”
We also disclose certain categories of personal information to show you targeted ads on third-party properties and expand the reach and effectiveness of our own marketing campaigns. While we do not disclose your personal information for money, these activities are considered “sales,” “sharing,” or “targeted advertising” under certain state privacy laws, and the table below provides more information about our practices. As described in more detail in our Privacy Policy, we collect personal information from various sources, including: directly from you, automatically when you access or use our Services, and from third-party sources.
We do not knowingly collect, sell, or share personal information about consumers under the age of 18.
We do not collect “sensitive” personal information as defined by state privacy laws.
We retain personal information for as long as necessary to carry out the purposes for which we originally collected it and for other purposes described in this Notice and our Privacy Policy
Your Privacy Rights
Opting Out of Sales, Sharing, and Targeted Advertising. Some of the activities described above and in our Privacy Policy may be considered “sales” or “sharing” of your personal information or use of your information for “targeted advertising.” You can opt out of cookie-based ad targeting on our website by clicking the “Your Privacy Choices ” link found in the footer of our website and following the instructions in the pop-up window. You may need to renew your opt-out choice if you use a different browser or device to access our Services, or if you clear your cookies. From within our app, you can opt out by navigating to the Privacy Information section under your account.
In addition to cookie-based ad targeting, we may disclose identifiers, such as your email address and phone number, to our advertising partners. These advertising partners translate that information into a unique identifier that they can then use to show ads that are more relevant to you across the web and in mobile apps. You may opt out of these disclosures by filling out our webform.
Depending on where you reside, you can also opt out by visiting our Services with a legally recognized universal choice signal enabled, such as the Global Privacy Control.
Access, Correction, and Deletion. You have the right to (1) request to know more about and access your personal information, including in a portable format, (2) request deletion of your personal information, and (3) request correction of inaccurate personal information. To request access, correction, or deletion of your personal information, you may submit this webform or contact Customer Service at 1-800-562-1465. We may verify your request by asking you to provide information related to your recent interactions with us, such as your name, email address, or phone number. You can also access, correct, or delete certain information stored within your online account at any time by logging into your online account.
Nondiscrimination. We will not discriminate against you for exercising your privacy rights.
Authorized Agents. If you are an authorized agent seeking to make an opt-out request for a consumer, please fill out this webform.
If you reside in California, you may also designate an authorized agent to submit an access, deletion, or correction request on your behalf. We may ask authorized agents to submit proof of their authority to make a request, such as a valid power of attorney or proof that they have signed permission from the consumer who is the subject of the request. In some cases, we may be required to contact the individual who is the subject of the request to verify his or her own identity or confirm the authorized agent has permission to submit the request. If you are an authorized agent seeking to make an access, correction, or deletion request on behalf of a California resident, please fill out this webform or contact Customer Service at 1-800-562-1465.
Appeals. If we deny your request, you may appeal our decision by contacting us at USDataProtection@Nespresso.com. If you have concerns about the result of an appeal, you may contact the attorney general in the state where you reside.
Notice of Financial Incentives
We provide discounts, rewards, exclusive offers and other benefits to customers, such as when they register for an account, participate in our promotional campaigns, or sign up for our marketing emails or text messages. These offerings may constitute “financial incentives” or “bona fide loyalty programs” under certain state privacy laws (for simplicity, we refer to these offerings as “financial incentives” throughout this Notice).
If you decide to participate in a financial incentive, we collect relevant personal information from you, such as identifiers (like your email address and phone number), commercial information (like your purchase history), and inferences (including about your favorite products and preferences). We disclose this information to our service providers that perform services on our behalf, including payment processing, product fulfillment, marketing, database management, analytics, and customer service.
You can opt into a financial incentive by creating an account, signing up to receive our marketing communications, or otherwise following the instructions we provide to participate. You have the ability to opt out of financial incentives at any time. To opt out of receiving text messages, please send a reply text that says “STOP.” To opt out of promotional emails, please follow the unsubscribe instructions in those communications. To opt out of other financial incentives, you can contact us at USDataProtection@Nespresso.com or use this webform to request we delete your personal data. Please note that if you request that we delete personal data that is essential to providing you with the financial incentive, we will not be able to provide you with such benefits going forward. For example, if you ask us to delete your email address, we will no longer be able to email you discounts or other exclusive offers or benefits. In some cases, we may provide additional terms and conditions when you sign up to participate in a financial incentive. The value of your personal data is reasonably related to the value of the offer or discount presented to you.
