Please read this privacy notice (“Notice”) carefully to understand our policies and practices regarding your Personal Data and how we will treat it.
This Notice explains how your Personal Data are collected, used, and disclosed by data controllers regarding processing of your personal data, Distribuidores Automáticos de Bebidas y Alimentos, S.A.U. (“DABA”) y Nestlé Nespresso, S.A. whose data and contact information is listed in the Section 11 of this Notice (hereafter referred to as “Nespresso”, “We”, “Us”, or “Data controllers”). It also tells you how you can access and update your Personal Data and make certain choices about how your Personal Data are used.
This Notice covers both our online and offline data collection activities, including Personal Data that We collect through our various channels such as websites, apps, third party social networks, Customer Relationship Centers, Boutiques, points of sales and events. Please note that the Personal Data that We collect through different channels is incorporated into your Nespresso account. (E.g. we will combine the information we collect through purchases you make on the Nespresso website with Personal Data that We collect at a Nespresso offline event). Please see Section 8 for further information on how to object to this.
If you fail to provide necessary Personal Data to us (We will indicate to you when this is the case, for example, by making this information clear in our registration forms), We may not be able to provide you with our goods and/or services. This Notice can change from time to time (see Section 10).

This Notice applies to Personal Data that We collect from or about you, through the methods described below (see Section 2), from the following sources:
Nespresso websites. Consumer-directed websites operated by or for Nespresso, including sites that We operate under our own domains/URLs and mini-sites that We run on third party social networks such as Facebook (“Websites”).
Nespresso mobile sites/apps. Consumer-directed mobile sites or applications operated by or for Nespresso, such as smartphone apps.
E-mail, text and other electronic messages through instant messaging systems. Electronic communications between you and Nespresso.
Nespresso CRC. Calls to our Customer Relationship Centers (“CRC”).
Nespresso Boutiques. Physical stores managed by Nespresso.
Offline registration forms. Printed registration and similar forms that We collect via, for example, postal mail, in-store demos, contests and other promotions, or events.
Points of Sales. Demonstrators present in physical third party stores to assist you with the registering of your machine and coffee ordering.
Data from other sources.. Third party social networks (e.g. such as Facebook, Google) or market researches (if feedback is not provided on an anonymous basis).
- PERSONAL DATA THAT WE COLLECT ABOUT YOU AND HOW WE COLLECT IT
Depending on how you interact with Nespresso (online, offline, over the phone, etc.), We collect various types of information from you, as described below.
Personal contact information. This includes any information you provide to Us that would allow Us to contact you, such as your name and surname, postal address, e-mail address, social network details, phone number or Nespresso membership number.
Account login information. Any information that is required to give you access to your specific account profile. Examples include your login ID/email address, screen name, password in unrecoverable form, and/or security question and answer.
Demographic information & interests. Any information that describes your demographic or behavioural characteristics. Examples include your date of birth, age or age range, gender, geographic location (e.g. postcode/zip code), favorite products, hobbies and interests, and household or lifestyle information.
Technical information about computer/mobile device. Any information about the computer system or other technological device that you use to access one of our Websites or apps, such as the Internet protocol (IP) address used to connect your computer or device to the Internet, operating system type, and web browser type and version. If you access a Nespresso website or app via a mobile device such as a smartphone, the collected information will also include, where permitted, your phone’s unique device ID, advertising ID, geo-location and other similar mobile device data.
Websites/app/communication usage information As you navigate through and interact with our Websites or newsletters, We use automatic data collection technologies to collect certain information about your actions. This includes information such as which links you click on, which pages or content you view and for how long, and other similar information and statistics about your interactions, such as content response times, download errors and length of visits to certain pages. This information is captured using automated technologies such as cookies (browser cookies, flash cookies) and web beacons, and is also collected through the use of third party tracking. You have the right to withhold your consent or object to the use of such technologies, for further details please see Section 3. You will be prompted with a pop-up message through which you can customize your choice (that can be updated anytime using the cookie preference center).
Market research & consumer feedback This includes information that you voluntarily share with Us about your experience of using our products and services.
Consumer-generated content. This refers to any content that you create and then share with Us on third party social networks or by uploading it to one of our Websites or apps, including the use of third party social network apps such as Facebook. Examples include photos, videos, personal stories, or other similar media or content and posts or PM you can leave on Nespresso social media pages. When authorized by you, We collect and publish consumer-generated content in connection with a variety of activities, including contests and other promotions, website community features, consumer engagement, and third party social networking (e.g. when tagging us in your publication).
Third party social network information. This refers to any information that you share publicly on a third party social network or information that is part of your profile on a third party social network (such as Facebook and Instagram (Meta Platform)) and that you allow the third party social network to share with Us. Examples include your basic account information (e.g. name, email address, gender, birthday, current city, profile picture, user ID, list of friends, etc.) and any other additional information or activities that you permit the third party social network to share. We receive your third party social network profile information (or parts of it) every time you download or interact with a Nespresso web application on a third party social network such as Facebook or Instagram, every time you use a social networking feature that is integrated within a Nespresso site or every time you interact with Us through a third party social network. To learn more about how your information from a third party social network is obtained by Nespresso, or to opt-out of sharing such social network information, please visit the website of the relevant third party social network.
Payment and Financial information. Any information that We need in order to fulfil an order, or that you use to make a purchase, such as your debit or credit card details (cardholder name, card number, expiration date, etc.) or other forms of payment (if such are made available). In any case, We or our payment processing provider(s) handle payment and financial information in a manner compliant with applicable laws, regulations and security standards such as PCI DSS.
Calls to CRC. Communications with a CRC will be recorded or listened into, in accordance with applicable laws, for local operational needs (e.g. for quality or training purposes). Where required by law, you will be informed about such recording at the beginning of your call.
Contact via Chat or WhatsApp Business. We analyze your interactions with our content (e.g., click-throughs, contact paths) to provide you with answers to queries raised through these channels.
Email. We analyse your interactions with our content (e.g. click through, opening of email) to provide you with personalised information based on your interests and preferences.

Cookies/Similar Technologies. Please see our Cookie Notice to learn how you can manage your cookie settings and for detailed information on the cookies We use and the purposes for which We use them.
Log Files. We collect information in the form of log files that record website activity and gather statistics about your browsing habits. These entries are generated automatically, and help Us to troubleshoot errors, improve performance and maintain the security of our Websites.
Web Beacons. Web beacons (also known as “web bugs”) are small strings of code that deliver a graphic image on a web page or in an email for the purpose of transferring data back to Us. The information collected via web beacons will include information such as IP Address, as well as information about how you respond to an email campaign (e.g. at what time the email was opened, which links you click on in the email, etc.). We will use web beacons on our Websites or include them in e-mails that We send to you. We use web beacon information for a variety of purposes, including but not limited to, site traffic reporting, unique visitor counts, advertising, email auditing and reporting, and personalization.

With your consent (where required), We use your Personal Data to provide you with information about goods or services (e.g. marketing communications or campaigns or promotions). This can be done via means such as email, ads, SMS, WhatsApp phone calls and postal mailings to the extent permitted by applicable laws. Some of our campaigns and promotions are run on third party websites and/or social networks. This use of your Personal Data is voluntary, which means that you can oppose to the processing of your Personal Data for this purposes. Third party social networks.
We use your Personal Data when you interact with third party social networking features, such as “Like” functions to serve you with advertisements and engage with you on third party social networks. You can learn more about how these features work, the profile data that We obtain about you, and find out how to opt out by reviewing the privacy notices of the relevant third party social networks.
Personalisation (offline and online).
With your consent (where required), We use your Personal Data (i) to analyse your preferences and habits, (ii) to anticipate your needs based on our analysis of your profile, (iii) to improve and personalise your experience on our Websites and apps; (iv) to ensure that content from our Websites/apps is optimised for you and for your computer or device; (v) to provide you with targeted advertising and content, and (vi) to allow you to participate in interactive features, when you choose to do so. For example, We remember your login ID/email address or screen name so that you can quickly login the next time you visit our site or so that you can easily retrieve the items you previously placed in your shopping cart. In case you are an unregistered user, we will save information about your shopping bag, your email address and provided identification data to enhance the purchase of the products in which you have expressed an interest. Based on this type of information, and with your consent (where required), We also show you specific Nespresso content or promotions that are tailored to your interests. The use of your Personal Data is voluntary, which means that you can oppose the processing of your Personal Data for this purpose. Collection Management.
To the extent permitted by applicable laws, credit reporting agencies and collection agents are third party companies that we use to help us verify your creditworthiness (particularly for invoiced orders) or to collect outstanding invoices. We use these types of agencies to manage collections and payments for services offered by Daba and Nespresso and, where appropriate, to claim payment, in the case of a debt that is certain, due and payable.

In accordance with applicable laws, We use your Personal Data for other general business purposes, such as conducting surveys to find out their opinion, conducting internal or market research and measuring the effectiveness of advertising campaigns. We reserve the right, should you have Member accounts, to reconcile those accounts into one single account. We also use your Personal Data to ensure our security.

In the event that Nespresso or its assets are acquired by, or merged with, another company including through bankruptcy, we will share your Personal Data with any of our legal successors. We will also disclose your Personal Data to third parties (i) when required by applicable law; (ii) in response to legal proceedings; (iii) in response to a request from a competent law enforcement agency; (iv) to protect our rights, privacy, safety or property, or the public; or (v) to enforce the terms of any agreement or the terms of our Website.

- DISCLOSURE OF YOUR PERSONAL DATA
In addition to the entities or ad-hoc in-country partners (in charge of Nespresso operations) mentioned in the Data controllers & contact section (see Section 11), We share your Personal Data with the following types of third party organization:
Service providers. These are external companies that We use to help Us run our business (e.g. order fulfilment, payment processing, fraud detection and identity verification, website operation, market research companies, support services, promotions, website development, data analysis, CRC, WhatsApp, instant messaging systems, etc.). Service providers, and their selected staff, are only allowed to access and use your Personal Data on Our behalf for the specific tasks that they’ve been requested to carry out, based on our instructions, and are required to keep your Personal Data confidential and secure. Where required by applicable law, you can obtain a list of the providers processing your Personal Data (see Section 11 to contact Us).
Credit reporting agencies/debt collectors. To the extent permitted by applicable law, credit reporting agencies and debt collectors are external companies that We use to help Us to verify your creditworthiness (in particular for orders with invoice) or to collect outstanding invoices.
Third party companies using Personal Data for their own marketing purposes. Except in situations where you have given your consent, We do not license or sell your Personal Data to third party companies for their own marketing purposes. Their identity will be disclosed at the time your consent is sought.
Third party recipients using Personal Data for legal reasons or due to merger/acquisition.. We will disclose your Personal Data to third parties for legal reasons or in the context of an acquisition or a merger (see Section 4 for details).
- RETENTION OF YOUR PERSONAL DATA
In accordance with applicable laws, We will use your Personal Data for as long as necessary to satisfy the purposes for which your Personal Data was collected (as described in Section 4 above) or to comply with applicable legal requirements.
- STORAGE AND/OR TRANSFER OF YOUR PERSONAL DATA
We use a variety of reasonable measures (described below) to keep your Personal Data confidential and secure. Please note, however, that these protections do not apply to information you choose to share in public areas such as third party social networks.
People who can access your Personal Data. Your Personal Data will be processed by our authorized staff, agents or suppliers that assist us in the management of our activities, on a need to know basis, depending on the specific purposes for which your Personal Data have been collected (e.g. our staff in charge of customer care matters will have access to your customer record).
Measures taken in operating environments. We store your Personal Data in operating environments that use reasonable security measures to prevent unauthorised access. We follow reasonable standards to protect Personal Data. The transmission of information via the Internet is, unfortunately, not completely secure and although We will do our best to protect your Personal Data, We cannot guarantee the security of the data during transmission through our Websites/apps.
Measures We expect you to take. It is important that you also play a role in keeping your Personal Data safe and secure. When signing up for an online account, please be sure to choose an account password that would be difficult for others to guess and never reveal your password to anyone else. You are responsible for keeping this password confidential and for any use of your account. If you use a shared or public computer, never choose to have your login ID/email address or password remembered and make sure to log out of your account every time you leave the computer. You should also make use of any privacy settings or controls We provide you in our Website/app.
Transfer of your Personal Data. The storage as well as the processing of your Personal Data as described above require that your Personal Data are ultimately transferred/transmitted to, and/or stored at, a destination outside of your country of residence, notably Switzerland. We will also transfer your Personal Data to countries outside the European Economic Area (“EEA”) (e.g. other Nespresso/Nestlé entities or ad-hoc in-country partners including to countries which have different data protection standards to those which apply in the EEA). We (i) have put in place European Commission approved standard contractual clauses to protect your Personal Data (and you have a right to ask Us for a copy of these clauses(by contacting Us as set out below) and/or (ii) will rely on your consent (where permitted by law)).

Where provided by law, you, your successors, representatives and/or proxies can request the:
- (i) Access to your personal data, that is, to access, review and request a physical or electronic copy of the information collected about you, as well as the origin of your personal data.

These rights can be exercised by visiting Nespresso, Boutiques, calling our CRC on 900 259 259 or sending Us an e-mail to datos.personales@Nespresso-sp.com attaching a copy of your ID or equivalent details (where requested by Us and permitted by law). If the request is submitted by a person other than you, without providing evidence that the request is legitimately made on your behalf, the request will be rejected.
Please note that any identification information provided to Us will only be processed in accordance with, and to the extent permitted by applicable laws.
Also, please note that you can access your customer file through the web or the App and consult your personal data, modify or update them at any time, or change the preferences you have communicated to us.
Moreover, please note that, in certain circumstances, We will not be able to delete your Personal Data without also deleting your user account. We may be required to retain some of your Personal Data after you have requested deletion, to satisfy our legal or contractual obligations. We may also be permitted by applicable laws to retain some of your Personal Data to satisfy our corresponding legal obligations. In this regard, you should take into consideration the retention periods established in Section 6.
Where available, our Websites have a dedicated feature through which you can review and edit the Personal Data that you have provided. Please note that We require our registered consumers to verify their identity (e.g. login ID/email address, password) before they can access or make changes to their account information. This helps prevent unauthorised access to your account.
In relation to processing operations based on legitimate interests, you may ask the DPO to weigh them up.
We hope that We can satisfy queries you may have about the way we process your Personal Data. However, if you have unresolved concerns you also have the right to complain to competent data protection authorities at www.aepd.es.

1. Purpose, company identity and contact information
1.1 These General Terms and Conditions of Sale are intended to regulate relations between DISTRIBUIDORES AUTOMÁTICOS DE BEBIDAS Y ALIMENTOS, S.A.U. (hereinafter DABA), a trading company incorporated under the laws of Spain, with registered office at Avenida Generalitat, 164-166, 08174 Sant Cugat del Vallès, and tax ID number A-59408492, recorded in the Commercial Registry of Barcelona in volume 20,467, folio 52, page no. B-6286, 1st entry, an official distributor of Nespressoin Spain and the Customer (hereinafter the Customer) related to all transactions carried out through the official remote channels of Nespresso: website www.Nespresso.com/es; Nespresso Customer Service phone 900 259 259; via WhatsApp Business 686 259 259; or the Nespresso App.

2. Effectiveness of the General Terms and Conditions of Sale
2.1 Every order placed with DABA through Nespresso's official remote channels will be governed by these General Terms and Conditions of Sale. By placing an order, the Customer acknowledges that they have read, understood, and unreservedly accepted these General Terms and Conditions of Sale. Therefore, we remind you of the importance of reading them carefully.
2.2 DABA reserves the right to amend these general terms and conditions of sale by publishing an updated version thereof on this web page, which shall be applicable to all orders placed subsequent to when DABA publishes the new version of its general terms and conditions of sale on the website.
3. Orders
3.1 When placing an order via this website, the Customer is making a request to purchase the products he has chosen in accordance with these General Terms and Conditions of Sale.
3.2 Orders including coffee made by the Customer via this website are subject to minimum purchase quantity. With regard to orders for other Nespresso products, there is no minimum amount for such orders. However, in case of marketing offers, the minimum order requirement in the specific Legal Rules will apply.
3.3 Products are offered on this website within the limits of amounts available. If an order exceeds the amount in stock, the Customer will be immediately informed of this circumstance. DABA reserves the right to distribute the existing products among its Customers in a fair and reasonable manner.
3.4 You will receive the invoice for your purchase in paper format with your order. If you need to obtain a duplicate or would like one of your invoices sent to you in electronic format, please contact our Customer Service Department on 900 259 259.4. Order Confirmations
4.1 By accepting these General Terms and Conditions of Sale, orders placed via the Internet and confirmed by DABA shall constitute a binding agreement that will be fully effective between the parties.
4.2 DABA reserves the right to reject orders in the event of force majeure or owing to non-payment.
4.3 Information recorded by DABA shall constitute absolute proof of the order and the transaction as a whole. Information recorded by the payment system shall constitute absolute proof of financial transactions.
4.4 If a product that has been ordered is not available, the Customer will be informed immediately and refunded the amount paid within no more than fourteen (14) calendar days following a notification in this respect.
4.5 In relation to the provisions of the above point, DABA may offer a product with similar characteristics of the same or greater quality at no extra cost If the Customer does not wish to accept the alternative product, they may cancel the order within fourteen (14) calendar days from its receipt in accordance with Section 8 “Returns”, and the amount paid will be reimbursed within the same term from the notification. In this case, the Customer may also exercise his right to withdrawal and termination under the same terms as he would for the originally requested product.
5. Prices
5.1 The prices payable for items requested by the Customer shall be as announced on the website at the time the Customer places his order. These prices shall be detailed in the confirmation of the order placed, including VAT or any other applicable tax, shipping costs and any other expense. In addition, the Customer may review the prices of Nespresso products on the Nespresso website: www.Nespresso.com/es.
5.2 The charge for shipping costs shall be billed according to the rates advertised on this website at the time the Customer places his order, calculated in particular according to the size of the order and the delivery method chosen by the Customer, whereby the Customer shall be duly informed of said amounts prior to placing his order.
6. Delivery
6.1 All orders confirmed by DABA shall be delivered to the delivery address appearing in our system, or to the delivery address specified by the Customer on placing his order or to the address of a Pick-up Point if the Customer has opted for this, and within the deadline associated with the service chosen by the Customer which will be confirmed in his order.
6.2 Deliveries of orders may only be made within the geographical regions specified on this website.
6.3 If delivery of the order cannot be completed owing to reasons that may not be attributed to DABA, we will try and contact the Customer to agree on a new location and date for delivery. If delivery still cannot be made, the order will be returned to DABA’s warehouses, whereupon we will proceed to fully reimburse the amounts received from the Customer within a period of fourteen (14) calendar days.

7. Inspection of goods
7.1 We would like to remind you that the Customer is responsible for checking the quantities, condition and state of the goods upon being delivered.
7.2 If the order is incomplete or has not been delivered as requested in the order, the Customer must contact and notify DATA within fourteen (14) calendar days following delivery of the order. Once DABA has certified that the defect has been brought about by reasons attributable to it, the company will replace the goods at no further cost.
8. Returns
8.1 Orders made using our remote channels (telephone, Internet or the Nespresso app) may be returned at any time after placing the order and within fourteen (14) days of receipt. To start the process, please contact us to notify us of your decision by contacting the Nespresso Customer Service Department, or by completing the returns form, which you can also request by calling our Customer Service line on 900 259 259 or by completing the contact form on our website. When you have notified us of your decision to return the goods, you have fourteen (14) calendar days during which to do so. Customers are responsible for the cost of returning the products, which is payable when they are collected from your address. The purchase price is reimbursed using the same method used to pay for the order within fourteen (14) days of the date on which the products returned were correctly received.
8.2 Requirements and instructions for returns: To be eligible for return, products must still be sealed in their original packaging, without being tampered with or damaged and provided that the item has not been used, and the Customer must have kept the corresponding sales receipt. The Customer is liable for any reduction in market prices of the goods returned. Customers are not entitled to return the goods if the pack is damaged or has been tampered with. Consumers must check that the goods are returned in identical or equivalent packaging to that in which they were received, ensuring that the goods are safe and in perfect condition. Otherwise, we reserve the right not to accept the goods returned. When you return the goods, you must enclose the duly completed returns form or a sheet of paper containing all the details of the purchase and a list of the products and quantities returned with their unit prices, which must be included inside the packaging with the goods or a sheet of paper with the data of the client making the purchase. The right of withdrawal and the return of goods must be exercised through the same channel through which the product was originally purchased.
We inform you that our return policy is limited to products/items that have not been unsealed, tampered with, or used. This is due to health protection or hygiene and food safety reasons.
9. Payments9.1 Cash on delivery for purchases should be paid when the goods are effectively handed over.
9.2 Payments by bank card will be charged when DABA manages your order. When the order is completed in our system and processed, the Customer receives the order confirmation email. Your credit card details will be encoded for security reasons.
10. Legal warranty on products
10.1 Our products are guaranteed in accordance with the specific terms and conditions stated in the product documentation.
Please see the aforementioned documentation for further details about the product warranty and about the use, handling and maintenance of Nespresso products.
10.3 Food products offered under the Nespresso trademark have suitably passed all quality control tests required by applicable legislation.
10.4. Nespresso is responsible for any lack of conformity that manifests itself within a period of three years from the delivery of the product (for those machines purchased after 01/01/2022). The delivery of the product is understood to be made on the day that appears on the invoice or purchase ticket or on the corresponding delivery note if it is later..
11. After-sales service and Attention to complaints and claims
11.1 DABA invites its Customers to take the time to familiarise themselves and to carefully read the terms and conditions of the after-sales service and commercial warranties at https://www.Nespresso.com/es/en/machine-assistance#!/ prior to placing an order.
11.2 Similarly, if the Customer has any problems or queries in relation to operation, maintenance or the after-sales service, you may contact Nespresso Customer Service over the phone by calling +34 900 259 259 or writing to the email address atencionalcliente@Nespresso-sp.es where he will be duly informed and advised. 11.3 Moreover, a Customer Service and Incident Management Department is on hand to receive any requests, complaints and claims through various channels.
DABA provides you with the NespressoCustomer Service helpline at 900 259 259, where you will be put through to the pertinent department, as well as offers you the website www.Nespresso.com/es. Moreover, you may personally come to any of our Nespresso Boutiques in Spain, where our staff will be delighted to help you and guide you as appropriate. DABA is committed to responding to all requests, complaints and claims within a maximum period of one month.
The European Commission provides consumers with a platform for solving consumer claims online. As a consumer, it is your right to use this method, which is available at the following link: https://commission.europa.eu/about-european-commission/departments-and-executive-agencies/justice-and-consumers_es.
12. Language
The agreement made between DABA and the Customer shall be established in Spanish.
13. Force Majeure
13.1 DABA guarantees the quality of products ordered via its website. All rights acknowledged by applicable legislation for consumers and users shall be guaranteed. DABA shall endeavour as far as possible to fulfil its obligations.
13.2 Nonetheless, DABA cannot be held responsible for delays or failures in delivery caused by circumstances reasonably beyond its control. Such circumstances may include strike action, war, natural disasters or other similar situations preventing production, transportation or delivery of products.
14. Code of Conduct
14.1 DABA considers that its business activity and the achievement of its targets must be met while adhering to its commitment to good corporate citizenship; accordingly, it applies a Code of Conduct with the aim of assuring the values governing all our business operations are upheld whilst respecting the law. 15. Responsibilities of the Customer
15.1 The Customer undertakes to make legal use of the services and products offered by DABA without contravening current legislation or adversely affecting the rights and interests of third parties.
15.2 The Customer guarantees the accuracy and preciseness of the data provided during the purchase process, avoiding any detrimental effect being caused to DABA as a result of incorrect data.
15.3 The Customer undertakes to pay the price stipulated for the products ordered.
115.4 Failure to comply with any of the terms and conditions of sale may give rise to the order being rejected by DABA without the need to issue notice to the Customer and without said party being entitled to any compensation whatsoever.
16. Applicable law and legislation
16.1 These General Terms and Conditions of Sale are governed by Spanish law. In the event of any dispute or conflict arising in the construal or application of these terms, the parties submit to the law courts determined by applicable legal regulations governing jurisdiction applicable to the location where compliance with the obligation is given or the location pertaining to the address of the consumer, whichever is applicable in the Customer’s capacity as an end consumer.
16.2 If the Customer is a company, the parties will submit to the law courts of Barcelona with express waiver of any other jurisdiction.

These terms and conditions govern your agreement as a Member of Nespresso&You, managed by Distribuidores Automáticos de Bebidas y Alimentos, S.A.U. (Avda. Generalitat 164-166), herein DABA, Nestlé España, S.A. (Avda. Països Catalans 51), herein Nestlé, and Nestlé Nespresso, S.A. (40 avenue de Rhodanie, 1003 Lausanne), hereinafter Nespresso. These Terms and Conditions will take effect on 13 June 2022 and shall remain in force until amended or replaced.
- What is Nespresso & You?
DABA, Nestlé and Nespresso run a customer loyalty programme. Registration is free of charge, and customers are allocated to one of three levels depending on how long they have been a Member and their consumption in the last twelve (12) months after the first coffee order provided that the minimum coffee orders have been placed according to their customer record through the following official channels: (i) the website of www.Nespresso.com, (ii) at any Nespresso Boutique, (iii) calling the free Nespresso or (iv) the Nespresso app, hereinafter the “Sales Channels”.
- How do I register for Nespresso & You?
You will be automatically registered for Nespresso&You when you register at any Nespresso Boutique in Spain by calling the free Nespresso Customer Service line on 900 259 259 or on the website www.Nespresso.com by providing your contact details and accepting the Privacy Policy regarding your personal information. You can start enjoying the benefits of being a Member of Nespresso & You as soon as you place an order for coffee through the abovementioned Sales Channels.
Your Member account is personal and non-transferable. You must keep your customer number and password securely and not share it with or disclose it to third parties. The use of personal data belonging to third parties is not permitted (only the data subject’s own data can be used).
To become a Member, you must have placed at least one order for coffee in the last twelve (12) months using the abovementioned Sales Channels, starting on the launch date of this program. Joint registrations are not permitted.
- 3. Nespresso & You levels
- Connoisseur: annual consumption of fewer than 600 capsules or membership for less than five years.
- Expert: annual consumption between 600 and 1,200 capsules and membership for between five and ten years.
- Ambassador: annual consumption in excess of 1,200 capsules and membership for ten years or more.
*Only capsules purchased through the Sales Channels in the Nespresso & You channels are counted; therefore, if you have acquired capsules through other pages or apps, they will not be taken into account when classifying your membership level or entitle you to benefits in the Nespresso & You Programme.
Your assignment to a membership level depends on how long you have been a Member of the programme or the volume of coffee you have ordered. The volume of capsules ordered is calculated between two anniversaries. The first anniversary is the date on which you first purchased coffee through one of the Nespresso Sales Channels as a Member. By anniversary, we mean the month (not the day) when you made your first coffee purchase. “Membership” means the number of complete years during which you have made at least one coffee purchase, starting with the first coffee purchase when the average period of activity is no longer than twelve (12) months.
The “membership” of inactive Members (with no valid capsule purchases billed in the last twelve (12) months) will be calculated from the date (month) when a new coffee order is placed after a period of inactivity.
“Capsule consumption” is defined as the number of capsules purchased:

If you breach these Terms and Conditions or misuse the advantages, we reserve the right to cancel your membership after sending your written notice.
The programme may be changed or cancelled.
The organisers accept no liability for loss, damage or costs of any nature (direct, indirect, consequential or of another type) deriving directly or indirectly from your membership, the advantages or the use of any material contained in the website that includes, for guidance purposes only, acts and omissions, regardless of whether such losses, requests or damages are the result of our negligence.
If, for some reason, any of the clauses of these Terms and Conditions should be invalid, illegal or unenforceable, this will be separated from the Terms and Conditions and shall be considered deleted without affecting the validity of the remaining clauses.
Nespresso accepts no liability for requests or damage caused by the use of advantages or services provided by third parties.
- Agreements
These Terms and Conditions, together with the Privacy Policy, make up the contractual relationships with regard to the membership and advantages of Nespresso & You. Likewise, you may consult the General Terms of Sale applicable to our products and services.
- Law and Jurisdiction
These Terms and Conditions are governed by Spanish law, and any disputes or discrepancy in the interpretation or application thereof shall be submitted to the Courts and Tribunals which, where applicable, are provided for in the applicable legal regulations regarding competent jurisdiction, in which, in the case of end consumers, is the place of performance of the obligation or the place of the consumer's domicile.

These terms and conditions apply in addition to the General Conditions of Sale published on the website www.Nespresso.com. By selecting your Subscription by Nespresso plan, you accept their content.

1. Who can sign up for a plan?
To sign up for a Subscription by Nespresso plan, you must be registered as a member of the Nespresso&You club, be at least 18 years old, and legally resident in Spain.
Each Nespresso&You member may have a maximum of two simultaneous Subscription by Nespresso plans (one for coffee and one for a machine).
2. Duration of the plan:
Your subscription will begin when you sign up for the plan of your choice and will be in effect for as long as you continue to make your monthly payments.
Coffee plan: you may cancel your coffee plan at any time without any penalty.
Machine plan: your machine plan will be in effect as long as the monthly payments are up to date. The plan is subject to a minimum term of 12 or 24 months from the moment you sign up, depending on which subscription you choose. If you cancel the plan before this term or do not make your payments on time, you will be liable to pay the penalty listed in Section 7-Cancellation of subscription.
DABA reserves the right to terminate your subscription plans at any time. However, you may use the credits generated by the payment of your monthly payments for 24 months from their generation.
3. What does the Nespresso subscription plan include?
If you meet the conditions listed in Section 1, “Who can sign up for a plan?” you can purchase the Subscription by Nespresso plan of your choice and agree to make the corresponding monthly payments.
When you activate your subscription plan (either the Coffee Plan or the Machine Plan), your monthly payment will be converted into Nespresso Credit. You can use this credit to buy coffee capsules and other Nespresso products. However, you cannot purchase other subscription plans with Nespresso credit.) The Nespresso Credit and Benefits mentioned in this clause and throughout these Terms and Conditions will continue whilst you are current with your monthly payments.
The following is a more detailed explanation of the benefits that apply to each plan:Coffee plan: When you activate your coffee plan, you will receive all the benefits pertaining to that plan in addition to your Nespresso credit. For more information, see Clause 5.
Machine plan: As a machine plan subscriber, you will receive the Nespresso machine corresponding to your subscription plan for a one-time charge of one (1) euro. You will also receive all the benefits pertaining to your selected machine plan. For more information about the machine and its benefits, see Section 5.
Your machine will be delivered once you have paid the charge (one euro (1€)), and your first monthly payment will depend on which subscription plan you have selected.
After the mandatory compliance period for your machine plan, unless you notify us that you wish to cancel the plan, you will continue to enjoy the benefits of your selected machine plan. You will also benefit from additional discounts on accessories and coffee capsules associated with your machine, as described in the coffee plan.
In addition to your coffee or machine plan, you can continue to make use of all your Nespresso&You club benefits, including coffee promotions under the conditions established in the legal rules and/or discounts depending on your level in the Nespresso&You scheme. You must check the legal rules of each promotion to see if it is compatible with your subscription plan.

4. Price and payment:
4.1. The Nespresso subscription plan has a fixed price, which is charged monthly at a fixed rate. Each subscription plan has a different price.
4.2 You will pay the first monthly payment when you sign up for your selected Subscription by Nespresso plan. If you would prefer to make your monthly payment on a different day of the month, please contact the Customer Service Centre on 900 259 259 or visit one of our Nespresso Boutiques. You must do this at least 15 days before the next payment date. In contrast, the frequency of the payments cannot be changed. Your monthly fees after the first payment are charged each month on the same day of the month that you activated your subscription or on your chosen day. If your payment day falls on a public holiday or non-business day, you will be charged on the next business day.
4.3 To ensure that your credit card is not used without your consent, we reserve the right to validate your name, address and any other personal information that you have provided during the purchase process or to register as a member of Nespresso&You. By accepting the terms and conditions of Subscription by Nespresso, you consent to the checks mentioned above, should DABA consider them necessary.
5. Nespresso Credits:
5.1. You can use the Nespresso credit generated by your monthly payments to buy coffee capsules and other Nespresso products (with the exception of subscription plans) at www.Nespresso.com, by calling 900 259 259 or at our Nespresso Boutiques. You may not use your subscription credit in Nespresso Self-Service areas, NCoffee Points, or non-participating points of sale. The amount of Nespresso Credit you receive is equal to the amount paid as your selected monthly subscription plan.
5.2. Your Nespresso Credit will be automatically added to your Nespresso&You account each month when your monthly payment is received.
5.3. Nespresso Credits are non-refundable, personal, non-transferable, and cannot be exchanged for cash. Credits may be used for twenty-four (24) months following their generation. After this period, they expire and become invalid. They cannot be used for any other purpose and will not be exchanged or compensated in any way. To check your Nespresso credit balance, please log into your account at www.Nespresso.com.
5.4. Nespresso Credits cannot be used to pay for another subscription plan.
5.5. The Nespresso Credit in your account will automatically be used to pay for the next order you place. In other words, the credit generated will automatically be used, and you cannot retain it for subsequent purchases.
5.6. If your Nespresso credit balance is insufficient to pay for the entire order for coffee capsules or other Nespresso products, you may opt to:
a) Use your Nespresso credit and pay the remainder with your credit card. This allows you to use the benefits of your subscription plan, as well as your coffee capsules and/or other Nespresso products.
b) Save the Nespresso Credit to acquire coffee capsules and/or other Nespresso products.
c) Purchase the Nespresso credit that will be generated with your next monthly Subscription by Nespresso plan payment. To do so, you must pay for next month's subscription in advance. Under no circumstances may you pay more than one monthly subscription plan instalment in advance.
5.7. Nespresso Credits are cumulative. If you have two simultaneous subscription plans (one for coffee and one for your machine), you can use the credit balance of both.
6. Benefits and features of your Nespresso plans
If you have a Coffee Plan, as well as your Nespresso credit, to thank you for being a subscriber, you will receive a fixed discount on your coffee orders (with the exception of the POP coffee plan). This discount is subject to a maximum monthly limit of 200 coffee capsules. The percentage of your discount will vary depending on your selected subscription plan, as shown in the table below. After the mandatory Machine Plan term, if you do not inform us that you wish to cancel the Plan, you will continue to enjoy the benefits of your chosen machine plan as well as the additional discounts on accessories and coffee capsules described in the Coffee Plan section that are associated with the same machine that you have contracted.
DABA reserves the right to discontinue any of the benefits of any of the plans at its discretion, 15 days' notice, without giving rise to the right to make claims of any kind by the subscribers against DABA.
7. Overdue payments
If we are not able to collect your monthly fee on the due day indicated in the “My Subscription” section on your Nespresso&You account, Nespresso's automated system will make a maximum of three further attempts on three consecutive days. If we are unable to collect the monthly fee, your outstanding balance will be carried over to the next month and included in your next payment. Please note that the subscription section of your Nespresso&You customer account will be blocked after two failed attempts to collect the monthly payments.
8.Cancellation of the subscription
If you wish to cancel your subscription, you can do so by logging into the Subscription section at www.Nespresso.com, contacting our Customer Care Centre at 900 259 259, or visiting a Nespresso Boutique. Self-service, NCoffee Points, and non-participating points of sale are excluded.
If you cancel your subscription, you will not be entitled to a refund for monthly fees paid before the date of termination. However, the Nespresso Credit generated and available in your Nespresso&You account may be used during the 24 months from the date of generation.
Cancellation of the Machine Plan: If you wish to cancel your machine subscription before the mandatory period, you must pay the corresponding amount for early termination:

9. Withdrawal period
Under no circumstances will the right to withdrawal apply to subscriptions (coffee and/or machine) taken out through in-person channels and at Nespresso Boutiques. Therefore, returns of machines linked to machine subscription plans taken out through in-person sales channels will not be accepted.
The right to withdrawal only applies to subscriptions taken out through distance sales channels, or outside a retail business. In the case of these contracts, you may cancel your Subscription by Nespresso plan, without providing a reason, within 14 days of activating your machine and coffee subscription plan of choice, with the exceptions below. If you wish to exercise this right, you must notify our Customer Service Centre by calling 900 259 259 so that they can process it through the procedure established in the General Conditions of Sale published on the website www.Nespresso.com or by calling the Customer Service Centre.
Machine subscription: To be able to exercise your right to withdrawal, provided you have arranged your subscription through a distance sales channel, you can return the machine received. It must be in its original packaging in perfect condition, unused and sealed, as described in the General Conditions of Sale. You must return the goods within 14 days of activating your subscription. In this case, remember that any Nespresso credits that you would have received for your Nespresso machine subscription will be cancelled, as your machine will be deemed to have been returned.
Coffee subscription: To exercise the right to withdrawal, provided you arranged your subscription through a distance selling channel, you must return the Nespresso coffee capsules to us. Please note that to exercise this right, the Nespresso coffee capsules must be in their original packaging and in perfect condition, and the unit box must be unopened and sealed, as indicated in the General Conditions of Sale.
If you meet the above requirements under your subscription plan to exercise the right of withdrawal, we will refund all payments made up to the date of cancellation, including delivery charges (with the exception of delivery charges beyond standard delivery and any others incurred as a result of exercising the right to withdrawal). The refund will be made via the same payment method that was used to activate the Subscription by Nespresso plan, and you will not be charged any extra amounts as a result of the refund. We will process the refund as soon as possible and, in any case, within 14 days of receiving the Nespresso machine and/or coffee capsules and, if applicable, within 14 days of providing us with proof that the goods received have been returned. If you cancel the plan before you receive the Nespresso coffee machine and/or capsules, we will refund the amount paid within 14 days of the date on which you inform us that you wish to exercise the right of withdrawal, provided that the goods in question are currently on DABA's premises or in transit when your decision is received. DABA reserves the right to withhold the monthly fee until the machine and/or Nespresso coffee capsules are properly received, in their original packaging, in perfect condition and sealed.
Please note that our returns policy requires that the products/items be sealed and not manipulated or used. This is for sanitary and food safety reasons.
10. After-Sales Service and Legal Guarantee of the Products

11. Amendments to these conditions
DABA reserves the right to amend these Terms and Conditions of Subscription by Nespresso by publishing the updated version on this page. The new version will apply to all subscriptions that are made after the new version is published. Likewise, in case the amendment affects existing subscribers, DABA will provide that you are duly notified by one of the methods by which you have consented to receive this type of information.
12. Code of Conduct
DABA undertakes to conduct its business and achieve its objectives in line with its commitment to corporate citizenship. Therefore, it has a Code of Conduct whose mission is to ensure conduct consistent with the values that govern all our business operations and abidance with the Law. The Terms and Conditions of Subscription by Nespresso are governed by Spanish law. Any disputes in the interpretation or application thereof will be referred to the Courts, which, where appropriate, have jurisdiction regarding the matter in question, which is the place of compliance with the obligation or the consumer's place of residence in the case of end consumers.
