Applicability of General Conditions of Sale
1.1 Each order placed with Nespresso Belgique SA or any of its affiliated companies (“Nespresso”) by means of the Internet www.Nespresso.com/be (the “Website”), mobile applications, Boutiques or phone shall be governed by the present General Conditions of Sale. They shall apply to the exclusion of all other conditions. By placing an order, you acknowledge that you have read, understood and accepted, without reserve, the present General Conditions of Sale.
1.2 Nespresso reserves the right, at any time, to modify the present General Conditions of Sale by posting a new dated version on the Website. By placing an order after Nespresso has posted a new version of its General Conditions of Sale, you agree to be bound by that updated version.
1.3 By using the Website, you also accept and agree to be bound by our Terms of Use and Internet Privacy Policy. Nespresso invites you to read them carefully before using the services provided on the Website.Orders (general)
2.1 You can place an order on the Website, the mobile applications, in our Boutiques or by phone.
2.2 Orders you place with Nespresso are subject to minimum and maximum quantity limitations as indicated on the Website.
2.3 Nespresso offers its products within the limits of its available stocks.
2.4 Nespresso reserves the right to refuse orders, notably in case of insolvency, unpaid invoices or (presumptive) fraud.
Orders online: registration and password
3.1 You can place an order on the Website once you have registered.
3.2 When you register on the Website, you must ensure that the mandatory registration information you provide is correct and complete.
3.3 Please inform Nespresso about changes of address or other modifications by updating your personal details on the Website without delay.
3.4 When registering to use the Website, you will be asked to create a password. You must keep this password strictly confidential and not disclose it or share it with anyone. You are fully responsible for the use of your password and any orders placed under it, even without your knowledge. If you know or suspect that someone else knows or has used your password, you should notify Nespresso immediately.
Confirmation of orders placed on the Website, mobile applications or by phone
4.1 By placing an order, you make an offer to purchase the products you have selected under these General Conditions of Sale, without prejudice to your right of withdrawal (article 9).
4.2 The order you place will not constitute a binding contract unless and until Nespresso transmits a confirmation by e-mail.
4.3 The data registered by Nespresso constitutes proof of the order and the entire transaction. The data registered by the payment system constitutes proof of the financial transactions.Prices
5.1 The prices payable for the items you order are those displayed on the Website or mobile applications on the date you place your order, inclusive of VAT.
5.2 Delivery charges will be billed at the rates indicated on the Website or mobile applications on the date you place your order, calculated notably in function of the size of the order and the delivery method you select.5.3 If the client requests a delivery method that differs from the standard method, used by Nespresso, any additional costs will incumbent upon the client.
5.4 Nespresso reserves the right to modify its prices and delivery charges for future orders at any time and to cancel a contract in case of writing, printing or calculation errors in which case potential damages suffered by you may be compensated.Customs Duties
6.1 When ordering products for international delivery to countries other than those where Nespresso originates its shipments, you are the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods.
6.2 You may be subject to import duties and taxes that are levied once the merchandise reaches your country. Any additional charges for customs clearance must be borne by you. We have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information.
Delivery
7.1 All orders confirmed by Nespresso will be delivered to the delivery address you specify when placing your order.
7.2 Nespresso does its utmost to ensure deliveries on the requested date. If Nespresso is not able to deliver the goods within 30 legal days, following the conclusion of the contract, the consumer has the right to terminate it without penalty end the right to obtain a refund.
7.3 Deliveries can only be made to an address in Belgium.7.4 The risks of loss and damage to the products are transferred to the client at time of receipt of the delivery.
Verification of Merchandise
8.1 It is your responsibility to verify the quantity and condition of the merchandise upon delivery.
8.2 In the following cases, Nespresso invites you to return the goods to the Boutique where the merchandise was purchased or to contact Nespresso:
8.2.1 In case of damage, quality problems or if the content of the delivery does not comply with your order.
8.2.2 If you want to recycle your old coffee machine when your new machine will be delivered.
Right of withdrawal for distance purchasing
9.1 You have the right to withdraw from this contract within 14 days without giving any reason.
9.2 The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
9.3 To exercise the right of withdrawal, you must inform Nespresso of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the model withdrawal form but it is not obligatory. You may send this form to:

Effects of withdrawal
10.1 If you withdraw from this contract, we shall reimburse to you all payments received from you and related to the withdrawal, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
10.2 We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
10.3 You shall send back the goods or hand them over to us or return them to a UPS point, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. Nespresso advises to return the goods as much as possible in the original packaging and accompanied by the invoice and the returns form. The deadline is met if you send back the goods before the period of 14 days has expired.
10.4 You will have to bear the direct cost of returning the goods.
10.5 You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
10.6 You lose your right of withdrawal as soon as you open or use/consume a coffee capsule and/or delicacy. Nespresso therefore advises you not to open the cardboard packages containing the products and to handle these packages with care.
11. Payment
11.1 You explicitly accept to receive your invoices electronically by using the services of Nespresso. You can stop the electronic sending of your invoices at any time by contacting Nespresso. In case of optout, your invoices will no longer be sent to your address in electronic form, but in paper form via postal mail to the address known by Nespresso.
11.2 Invoices are sent by e-mail to the e-mail address you provided at the moment your order is sent. The electronic sending and consultation of your invoices is free of charge.
11.3 Invoices must be fully paid within 30 days.
11.4 Payment by credit card is immediately due and payable. Your credit card details will be encrypted for security purposes.
11.5 The delivered merchandise remains the property of Nespresso until full payment of the invoice.
Late Payment.
12.1 Nespresso reserves the right to refuse any new order until full payment of any overdue balance.
12.2 In the event of non-payment of the invoice on the due date, a first reminder will be sent. Thereafter, if the customer does not pay the invoice, an amount of €10 will be automatically billed without notice. If the amount due remains unpaid within 14 days, the amount of the invoice will be automatically increased by 10% with a minimum of 25 euro and without formal notice (fixed fine). To these costs are added interests and any extrajudicial costs.
12.3 If an invoice is not paid by the due date, all other open invoices become due immediately.
Machine Warranty
13.1 Machines purchased on the Website are guaranteed by the machine manufacturer pursuant to the specific terms and conditions listed in the original product documentation.
13.2 Please consult your product documentation for detailed information on the manufacturer's warranty, which is without prejudice to any of your imperative statutory legal rights as provided for in the legislation on the sale of consumer goods.
After-Sales Service
14.1 If you encounter any problems or have any questions concerning the functioning, maintenance or after-sales service of your machine, please contact Nespresso by telephone for advice and assistance.
14.2 If your machine problem cannot be resolved by telephone, Nespresso proposes a series of advantageous after-sales service options. Please contact Nespresso by telephone for detailed information.Limitation of Liability
15.1 The photographs and texts illustrating and describing the products on the Website are non-contractual and for information purposes alone. Except in case of willful misconduct or gross negligence, Nespresso shall not be liable in case of errors or omissions in the photographs or texts displayed on the Website.
15.2 For international deliveries to countries other than those where Nespresso originates its shipments, Nespresso shall have no liability if the products do not comply with the laws and regulations of the country of delivery or in case of electrical or other product incompatibility.
15.3 Without limiting the scope of these General Conditions of Sale, no claim of any kind, whether as to products delivered or non-delivery of products, or otherwise, shall be greater in amount than the purchase price of the products in respect of which damages are claimed. IN NO EVENT SHALL Nespresso BE LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY NATURE (EVEN IF THE ADVENT OF SUCH DAMAGE WAS KNOWN OR COULD HAVE BEEN KNOW BY Nespresso), CAPABLE OF ARISING IN CONNECTION WITH ITS PRODUCTS, THEIR USE, SALE OR THE WEBSITE.
Force Majeure
16.1 Nespresso will make every reasonable effort to fulfill its obligations. However, Nespresso cannot be held responsible for delays or failure to deliver caused by circumstances beyond its reasonable control. Such circumstances include strikes, wars, natural catastrophes or any others that make impracticable the production, transportation or delivery of products.
16.2 In the event of delay, Nespresso will perform its obligations as soon as reasonably possible, and it reserves the right to allocate any remaining product supply among customers in a fair and reasonable manner.
Applicable Law and Forum
17.1 The present General Conditions of Sale are governed by the laws of Belgium.
17.2 The exclusive forum is Brussels.

1. Acceptance and Modification of the Terms of Use.
1.1 Your access and use of the websites (the “Websites”) of Nestlé Nespresso S.A. (“Nespresso”), which includes Nespresso’s affiliated companies, are governed by the present terms of use (the “Terms of Use”). 11. Miscellaneous
11.1 The present Terms of Use embody the entire agreement concluded between Nespresso and yourself concerning the access and the use of the Websites and their content. Any other terms or conditions issued by Nespresso and governing its relations with you, in particular relating to any service or purchase of product, shall supplement the Terms of Use; in the event of any inconsistency between them, the other terms or conditions shall prevail over these Terms of Use.
11.2 The fact that Nespresso tolerates a violation by yourself of one of the obligations set out in the Terms of Use, or does not enforce a right attributed to it thereunder or under the law shall not be construed as a waiver by it to invoke and enforce its rights.

Offline registration forms . Printed registration and similar forms that We collect via, for example, postal mail, in-store demos, contests and other promotions, or events.
Points of Sales. Demonstrators present in physical third-party stores to assist you with the registering of your machine and coffee ordering.
Data from other sources . Third party social networks (e.g. such as Facebook, Google) or market researches (if feedback not provided on an anonymous basis).
Consumer-generated content . This refers to any content that you create and then share with Us on third-party social networks or by uploading it to one of our Websites or apps, including the use of third-party social network apps such as Facebook. Examples include photos, videos, personal stories, or other similar media or content and posts or PM you can leave on Nespresso social media pages. Where permitted, We collect and publish consumer-generated content in connection with a variety of activities, including contests and other promotions, website community features, consumer engagement, and third-party social networking”.
Telemetry Data . We may collect certain data captured by Nespresso coffee machines that are connected to Wi-Fi. Examples include the machine Serial Number, machine alerts or errors, and the type of coffees prepared by consumers, with the respective date and time.
2.PERSONAL DATA THAT WE COLLECT ABOUT YOU AND HOW WE COLLECT IT
Depending on how you interact with Nespresso (online, offline, over the phone, etc.), We collect various types of information from you, as described below.
Personal contact information. This includes any information you provide to Us that would allow Us to contact you, such as your name, postal address, e-mail address, social network details, or phone number
Account login information. Any information that is required to give you access to your specific account profile. Examples include your login ID/email address, screen name, password in unrecoverable form, and/or security question and answer.
Demographic information & interests. Any information that describes your demographic or behavioral characteristics. Examples include your date of birth, age or age range, gender, geographic location (e.g. postcode/zip code), favorite products, hobbies and interests, and household or lifestyle information.
Technical information about computer/mobile device . Any information about the computer system or other technological device that you use to access one of our Websites or apps, such as the Internet protocol (IP) address used to connect your computer or device to the Internet, operating system type, and web browser type and version. If you access a Nespresso website or app via a mobile device such as a smartphone, the collected information will also include, where permitted, your phone’s unique device ID, advertising ID, geo-location, and other similar mobile device data.
Websites/communication usage information. As you navigate through and interact with our Websites or newsletters, We use automatic data collection technologies to collect certain information about your actions. This includes information such as which links you click on, which pages or content you view and for how long, and other similar information and statistics about your interactions, such as content response times, download errors and length of visits to certain pages. This information is captured using automated technologies such as cookies (browser cookies, flash cookies) and web beacons, and is also collected through the use of third-party tracking. You have the right to object to the use of such technologies, for further details please see Section 3.
Market research & consumer feedback. This includes information that you voluntarily share with Us about your experience of using our products and services.
Third party social network information. This refers to any information that you share publicly on a third-party social network or information that is part of your profile on a third-party social network (such as Facebook) and that you allow the third-party social network to share with Us. Examples include your basic account information (e.g. name, email address, gender, birthday, current city, profile picture, user ID, list of friends, etc.) and any other additional information or activities that you permit the third party social network to share. We receive your third-party social network profile information (or parts of it) every time you download or interact with a Nespresso web application on a third-party social network such as Facebook, every time you use a social networking feature that is integrated within a Nespresso site (such as Facebook Connect) or every time you interact with Us through a third-party social network. To learn more about how your information from a third-party social network is obtained by Nespresso, or to opt-out of sharing such social network information, please visit the website of the relevant third-party social network.
Payment and Financial information. Any information that We need in order to fulfil an order, or that you use to make a purchase, such as your debit or credit card details (cardholder name, card number, expiration date, etc.) or other forms of payment (if such are made available). In any case, We or our payment processing provider(s) handle payment and financial information in a manner compliant with applicable laws, regulations and security standards such as PCI DSS.
Calls to CRC . Communications with a CRC will be recorded or listened into, in accordance with applicable laws, for local operational needs (e.g. for quality or training purposes). Payment card details are not recorded. Where required by law, you will be informed about such recording at the beginning of your call.
Email . We analyze your interactions with our content (e.g. click through, the opening of email) to provide you with personalized information based on your interests and preferences.
3.COOKIES/SIMILAR TECHNOLOGIES, LOG FILES AND WEB BEACONS

5. DISCLOSURE OF YOUR PERSONAL DATA
In addition to the Nespresso/Nestlé entities or ad-hoc in-country partners (in charge of Nespresso operations) mentioned in the data controllers & contact section (see Section 11), We share your Personal Data with the following types of third-party organization:
Service providers. These are external companies that We use to help Us run our business (e.g. order fulfilment, payment processing, fraud detection and identity verification, website operation, market research companies, support services, promotions, website development, data analysis, CRC, etc.). Service providers, and their selected staff, are only allowed to access and use your Personal Data on Our behalf for the specific tasks that they’ve been requested to carry out, based on our instructions, and are required to keep your Personal Data confidential and secure. If the law in force requires so, you can obtain a list of the service providers who process your Personal Data.
Credit reporting agencies/debt collectors . To the extent permitted by applicable law, credit reporting agencies and debt collectors are external companies that We use to help Us to verify your creditworthiness (in particular for orders with invoice) or to collect outstanding invoices.
Third party companies using Personal Data for their own marketing purposes. Except in situations where you have given your consent, We do not license or sell your Personal Data to third party companies for their own marketing purposes. Their identity will be disclosed at the time your consent is sought.
Third party recipients using Personal Data for legal reasons or due to merger/acquisition. We will disclose your Personal Data to third parties for legal reasons or in the context of an acquisition or a merger (see Section 4 for details).
6. RETENTION OF YOUR PERSONAL DATA
Nespresso takes every reasonable step to ensure that your personal data are only processed for the minimum period defined as per the following criteria:
(a) Nespresso will retain copies of your Personal Data in a form that allows for identification only for as long as:
(i) We maintain an ongoing relationship with you (e.g. where you are included in our mailing list and have not unsubscribed; until you withdraw your consent for processing of your personal data for marketing purposes or until you object to the processing for this purpose),
(ii) Your Personal Data are necessary in connection with the purposes set out in this Notice and we have a valid legal basis,

(b) The duration of any applicable limitation period for claims/tax obligations related to a given purpose of processing plus additional one year calculated as of the end of the year in which an applicable limitation period has concluded. This additional one year is in case of claims exercised shortly before the end of an applicable limitation period and serves to determine one date, when the data will be deleted, destroyed or anonymised. In addition, if any relevant legal claims are brought, we may continue to process your Personal Data for such additional time necessary in connection with that claim.
7.DISCLOSURE, STORAGE AND/OR TRANSFER OF YOUR PERSONAL DATAWe use a variety of reasonable measures (described below) to keep your Personal Data confidential and secure. Please note, however, that these protections do not apply to information you choose to share in public areas such as third-party social networks.
People who can access your Personal Data . Your Personal Data will be processed by our authorised staff or agents, on a need-to-know basis, depending on the specific purposes for which your Personal Data have been collected (e.g. our staff in charge of customer care matters will have access to your customer record).
Measures taken in operating environments . We store your Personal Data in operating environments that use reasonable security measures to prevent unauthorised access. We follow reasonable standards to protect Personal Data. The transmission of information via the Internet is, unfortunately, not completely secure and although We will do our best to protect your Personal Data, We cannot guarantee the security of the data during transmission through our Websites/apps.
Measures We expect you to take. It is important that you also play a role in keeping your Personal Data safe and secure. When signing up for an online account, please be sure to choose an account password that would be difficult for others to guess and never reveal your password to anyone else. You are responsible for keeping this password confidential and for any use of your account. If you use a shared or public computer, never choose to have your login ID/email address or password remembered and make sure to log out of your account every time you leave the computer. You should also make use of any privacy settings or controls We provide you in our Website/app.
Transfer of your Personal Data . The storage as well as the processing of your Personal Data as described above require that your Personal Data are ultimately transferred/transmitted to, and/or stored at, a destination outside of your country of residence, notably Switzerland and Luxembourg. We will also transfer your Personal Data to countries outside the European Economic Area (“EEA”) (e.g. other Nespresso/Nestlé entities or ad-hoc in-country partners) including to countries which have different data protection standards to those which apply in the EEA. We (i) have put in place European Commission approved standard contractual clauses to protect your Personal Data (and you have a right to ask Us for a copy of these clauses (by contacting Us as set out below) and/or (ii) will rely on your consent (where permitted by law).
8.YOUR RIGHTS RELATED TO YOUR PERSONAL DATA
Access to Personal Data . Where provided by law, you, your successors, representatives and/or proxies have the right to access, review and request a physical or electronic copy of information held about you. You also have the right to request information on the source of your Personal Data.
These rights can be exercised by sending Us an e-mail dataprotectionbelux@ Nespresso.com or writing to us at Nespresso Belgium Rue de Birmingham 221 1070 Brussels, attaching a copy of your ID or equivalent details (where requested by Us and permitted by law). If the request is submitted by a person other than you, without providing evidence that the request is legitimately made on your behalf, the request will be rejected.
Please note that any identification information provided to Us will only be processed in accordance with, and to the extent permitted by applicable laws.
Additional rights (e.g. modification, deletion of Personal Data). You, your successors, representatives and/or proxies can (i) request deletion, the portability, correction or revision of your Personal Data; (ii) oppose the data processing (also for direct marketing purposes); (iii) limit the use and disclosure of your Personal Data; and (iv) revoke consent to any of our data processing activities.
Please note that, in certain circumstances, We will not be able to delete your Personal Data without also deleting your user account. We may be required to retain some of your Personal Data after you have requested deletion, to satisfy our legal or contractual obligations. We may also be permitted by applicable laws to retain some of your Personal Data to satisfy our business needs.
Where available, our Websites have a dedicated feature through which you can review and edit the Personal Data that you have provided. Please note that We require our registered consumers to verify their identity (e.g. login ID/email address, password) before they can access or make changes to their account information. This helps prevent unauthorised access to your account.
We hope that We can satisfy queries you may have about the way we process your Personal Data. However, if you have unresolved concerns you also have the right to complain to competent data protection authorities.
9.YOUR CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR PERSONAL DATA

To opt-out of marketing communications sent by any medium, including third party social networks, you can opt-out at any time by logging into the Websites/apps or third-party social networks and adjusting your user preferences in your account profile by unchecking the relevant boxes or by calling our CRC. Please note that, even if you opt-out from receiving marketing communications, you will still receive administrative communications from Us, such as order or other transaction confirmations, notifications about your account activities (e.g. account confirmations, password changes, etc.), and other important non marketing related announcements.

These Rules govern your conduct, agreement and the rights of Nestlé Nespresso SA (“Nespresso”) as relates to the Consumer Ratings and Review Service offered by Sprinklr (the "Service"). By submitting any Content to the Service, you agree to the following Rules. As used herein, Content means any text, photo, video, likeness or other material or information you provide to the Service.

You represent and warrant to Nespresso that you own all Content and/or have the unencumbered legal right to grant the above-referenced license to Nespresso, with respect to all Content that you submit. You also represent that such materials do not infringe on any third party copyrights or other third party intellectual property rights.
Release and Indemnification

Membership is free of charge. There are three levels of membership and the member’s level is determined by the seniority and the amount of capsules purchased during 12 months starting at the first purchase of coffee. The Purchase must be made as an identified member through the ecommerce, boutiques or Call center.2. How to be a Member?
By registering, in our boutiques, through our Customer Call Center or online at www.Nespresso.com/lu you will automatically join. We will ask you to provide us with your contact details.

Your membership starts from the moment you successfully complete your registration form and receive a unique Member number. If you are already a Member, your membership shall be considered started on the date of your first coffee purchase at Nespresso.
You must keep your membership number and password safe and not divulge them to any person other than us. You may not allow others to use your registration details and password to access the Website. You agree to immediately notify us of any unauthorized use of your registration details and password or any other breach of security of which you become aware.
To become a Member you must have had at least 1 valid coffee order in the last 12 months. Corporate bodies, partnerships, trade associations and other commercial bodies are eligible but only one membership is available per person. Joint or family membership is not available. Persons under 18 years of age are excluded.3. The three Membership statuses
- Connoisseur: after registration as a customer and after your first valid coffee purchase.
- Expert: after 5 years as an active Nespresso customer or an annual consumption of 1.000 capsules or more a year.
- Ambassadeur: after 10 years as an active Nespresso customer or an annual consumption of 1.500 capsules or more a year.
4. What determines your Membership status?
Your membership status is determined by two elements:- Seniority meaning the number of entire years with at least one coffee (Classic or Vertuo) purchase since the first coffee purchase. If you become inactive as a Member (last 12 months without any invoiced and valid capsules), your Seniority is reset to 0.
- Capsules consumption meaning the amount of capsules that you purchased during the first twelve months after the first purchase or between 2 Anniversaries. By Anniversary, we mean the month (not the day) of your first coffee purchase. Your first Anniversary refers to your first purchase of coffee through one of the Nespresso Channels as an identified Member. The Purchase needs to contain a valid order number. The date of the Purchase refers to the shipping date of the coffee capsules. Classic or Vertuo capsules purchase included. Cancelled or returned orders are deducted.
Your seniority and your capsule consumption can be consulted on My account.
5. Membership Benefits
Nespresso Membership Benefits is offered to you free of charge and we reserve the right to discontinue or modify all part of the Benefits or the content of the website, at our sole discretion at any time with and without notice. All Benefits are subject to availability and as long as the stock lasts.

You may terminate your membership at any time by writing to Nespresso by postal mail Nespresso Luxembourg SA, Grand-Rue 95, L-1661 Luxembourg, by email (https://www.Nespresso.com/lu/en/contact-us) or by calling the free number 8002 26 33. In such case we will delete your personal details.
We may terminate your membership immediately by written notice to you in case of breach any of these terms and conditions, abuse the Benefits or fraud attempt.
We may terminate this program at any time upon three months’ notice to you.7. Liability
We disclaim, to the fullest extent permissible by law, all liability for losses, damages and costs whatsoever, (whether direct, indirect, consequential or otherwise), arising, either directly or indirectly, from your membership, the benefits or the use of any material contained on the website by you, including without limitation any acts or omissions, whether those losses claims or damages result from our negligence or otherwise.
We do not exclude our liability to you for:- death or personal injury caused by our negligence; or
- fraudulent misrepresentation by us.
Nespresso is not responsible for any claims or damages arising from use of any benefits or services provided by a third party.
If any provision of these Terms and Conditions is or becomes for any reason whatsoever invalid, illegal or unenforceable, it shall be divisible from these Terms and Conditions and shall be deemed to be deleted from them and the validity of the remaining provisions shall not be affected in any way.8. Intellectual property
All copyright and other intellectual property rights in all texts, images and other materials on the Membership website are the property of Société des Produits Nestlé SA.

These terms and conditions apply to your agreement with Nespresso Belgium N.V. ("Nespresso") upon subscribing to the Nespresso Coffee Subscription ("Terms and Conditions of the Nespresso Coffee Subscription"). 1. What is the Nespresso Coffee Subscription?
1.1 The Nespresso Coffee Subscription is a coffee subscription that offers discounts on Nespresso coffee, with the amount of the discount increasing the longer you maintain your subscription. The Nespresso credit you receive is equal to the fixed amount you pay each month. The Nespresso credit is automatically credited to your Nespresso account and can be spent immediately or at a later time on Nespresso products, either online via the Nespresso App, through the customer service hotline, or in one of our Boutiques. The specific terms are explained below.
2. What is the duration of the Nespresso Coffee Subscription?
2.1 The Nespresso Coffee Subscription can be canceled at any time without charge.
3. Who can participate?
3.1 Individuals aged 18 and over can subscribe to the Nespresso Coffee Subscription.
3.2 To subscribe to a Nespresso Coffee Subscription, you must register as a customer with Nespresso. This can be done on Nespresso.com or in one of our Boutiques. To subscribe to the Nespresso Coffee Subscription, you must have a Belgian customer account. You can register as a Nespresso customer via Nespresso.com/be or in one of our Boutiques. There is a limit of one Nespresso (Coffee) subscription per registered Nespresso customer number, bank account, and/or credit card.
4. How much does the Nespresso Coffee Subscription cost?
4.1 The amount you pay varies and depends on which Nespresso Coffee Subscription you select. You can choose from the following subscription types and corresponding monthly amounts: €25, €40, €55, and €70. 5. What is included in the Nespresso Coffee Subscription?
5.1 The Nespresso credit you receive is equal to the fixed amount you pay each month as described in Article 4.1. The Nespresso Coffee Subscription only offers discounts on Nespresso coffee capsules. The amount of the discount depends on the subscription duration. The discounts are as follows:
o Month 0: 5% discount
o Month 4: Upgrade to 8% discount
o Month 7: Become an Ambassador (free membership)
o Month 10: Upgrade to 10% discount
5.2 You will also receive a welcome gift upon signing up. This is a one-time gift linked to your customer number. If you cancel your subscription and later reactivate it, you will not be entitled to a new welcome gift. The welcome gift may be subject to changes; any changes will be specified in a timely manner and updated on https://www.Nespresso.com/lu/en/coffee-subscription.
6. How does the monthly Nespresso credit work?
6.1 The Nespresso credit you are eligible for will be credited monthly to your linked Nespresso account within 2 business days after the final receipt of the monthly contribution. You can check your remaining Nespresso credit balance by logging into your account at Nespresso.com/be.
6.2 Nespresso credit is non-refundable and non-transferable and cannot be exchanged for cash.
6.3 The discounts offered cannot be combined with other promotional discounts. In this case, the highest discount will be applied. Exceptions are campaigns that involve offering a free product (such as coffee or accessories) when a certain threshold is met, where combinations with the subscription are allowed.
6.4 Nespresso reserves the right to stop or pause the payment of the credit at any time in cases of, but not limited to, suspected fraud, abuse of the subscription, or other irregularities. In such cases, Nespresso will inform you and take the necessary steps to investigate the situation.
6.5 Only one plan is possible per person/customer account.
6.6 Your credit is valid for 2 years from the moment you receive the credit in your personal account.
7. How can I set up a repeat order?
After setting up the Nespresso Coffee Subscription, it is possible to schedule a recurring order. For setting up a repeat order, please refer to your personal account on our website: https://www.Nespresso.com/lu/en/myaccount/standing-orders#/orders/list.
8. How do I subscribe to the Nespresso Coffee Subscription?
8.1 You can subscribe to the Nespresso Coffee Subscription directly in the Boutique or online via the Nespresso website using iDeal or credit card payment. The first monthly contribution is paid at the time you subscribe to the Nespresso Coffee Subscription. The subsequent monthly payments will be automatically deducted from your bank account/credit card on the same day and from the same bank account/credit card used to purchase your Nespresso Coffee Subscription. You can change the payment date of the Nespresso Coffee Subscription through customer service.
9. Is there a minimum number of coffee capsules that must be ordered?
9.1 Nespresso coffees are packaged in cases, each containing 10 capsules. Due to packaging regulations, all online orders must contain a minimum of 50 capsules and multiples of 50 capsules (50, 100, 150, etc.). You can vary the different coffees in your order, as long as the total is a multiple of 50 (e.g., 20 Roma, 10 Arpeggio, 10 Livanto, 10 Caramelito).
10. What happens if my Nespresso credit is not sufficient to meet the minimum order quantity?
10.1 We understand that your Nespresso coffee subscription credit may not always provide enough Nespresso credit to meet the minimum order quantity of 50 capsules. You have two options:
o Use your available Nespresso credit and pay the remaining balance with your credit card.
o Save your Nespresso credit until you have enough to order your favorite Nespresso coffee and accessories.
11. When will my coffee be delivered?
11.1 You can determine when you want your coffee or other Nespresso products delivered to your home. To do this, place an order on our website or purchase your coffees in one of our Boutiques.
12. What about the withdrawal period?
If you have subscribed via our website, you have the right to change your mind and withdraw from the Nespresso Coffee Subscription without giving a reason within fourteen days after you (or a person designated by you) have subscribed to the Nespresso Coffee Subscription (the "withdrawal period"). To exercise this right, you must inform us during the withdrawal period through an unambiguous statement of your decision. More information about the right of withdrawal can be found at www.Nespresso.com/lu/en/legal under Right of Withdrawal. This is also found in the general sales conditions under Articles 9 and 10.
13. How long does the Nespresso Coffee Subscription last and how can I cancel it?
13.1 The Nespresso Coffee Subscription has no fixed term. The Nespresso Coffee Subscription can be canceled at any time without charge.
13.2 Cancellation is possible by contacting Nespresso, for which we refer you to the contact details at /nl/nl/service-customer-care or through my account/my Nespresso Subscription at Nespresso.com/nl (self-cancellation online is only possible if all payments have been made). You are not entitled to a refund of the monthly amounts you have already paid at the time of cancellation.
13.3 To avoid automatic payment, you must submit the request to stop at least 36 hours before the scheduled payment.
13.4 After canceling the Nespresso Coffee Subscription, you have up to two years after receiving the Nespresso credit to use any remaining credit for purchases. The benefits associated with the Nespresso Coffee Subscription, as described in the General Sales Conditions of the Nespresso Coffee Subscription, will expire immediately upon termination of the Nespresso Coffee Subscription.
13.5 Nespresso reserves the right to terminate your Nespresso Coffee Subscription at any time.
14. Can I change my coffee subscription?
14.1 It is not possible to change the monthly amount of your Nespresso Coffee Subscription. You can cancel your Nespresso Coffee Subscription and subscribe to a new coffee subscription. The cancellation conditions as described in Article 13 will apply in that case.
15. What if my payment fails?
15.1 If the payment of your monthly contribution fails on the due date, Nespresso's automated system will attempt to process it again for three consecutive days. Any outstanding balance will be carried over so that the next payment will cover both the past due and current month. After two failed payments, Nespresso Belgium nv will suspend your access to your Nespresso account until the owed amount is paid. Consequently, the Nespresso Coffee Subscription will be terminated.
16. Other provisions
16.1 Terms of use: Nespresso reserves the right to change these general terms and conditions regarding the Nespresso Coffee Subscription from time to time at its discretion. When this occurs, we will appropriately inform participants in the Nespresso Coffee Subscription who are affected.
16.2 Privacy: The (personal) data necessary for participation in the Nespresso Coffee Subscription will be processed by Nespresso in accordance with Nespresso's privacy statement, as stated at https://www.Nespresso.com/lu/en/legal.
16.3 Updates and notifications: Nespresso will keep you informed via email of updates to the Nespresso Coffee Subscription and inform you about your outstanding Nespresso credit during the term of the Nespresso Coffee Subscription.
16.4 Contact information: For additional information, any questions, or complaints regarding the Nespresso Coffee Subscription, you can contact the Customer Relationship Centre by phone at 8002 26 33 or via the online form at https://www.Nespresso.com/lu/en/contact-us. Depending on the nature of your question/complaint and the way you have contacted the Customer Relationship Centre, you will receive a response by phone or email. You will receive a reply from Nespresso within four weeks.

Nespresso Easy Machine offers you monthly Nespresso coffee credit as well as your very own Nespresso machine for just €29.
1. Who can benefit from Nespresso Easy ?
Customers must be aged 18 or over. The offer is limited to one Nespresso Easy subscription for each Nespresso customer number.
2. Do I need to be a customer of Nespresso to subscribe to a Nespresso Easy plan ?
Yes, in order to subscribe to a Nespresso Easy plan, you need to register as a customer with Nespresso. To do so, go to www.Nespresso.com or visit one of our Boutiques.
3. How much does Nespresso Easy cost ?
The cost depends on the Nespresso Easy plan you have chosen. You will pay a fixed monthly fee.

The Nespresso credit you receive depends on the Easy plan fee you have chosen.
If you opt for the Nespresso Easy Machine subscription, you will buy a Nespresso machine from the Nespresso machines on offer for just €29 subject to a minimum subscription period of 12 months for the coffee plan linked to the chosen machine. You can pick up the chosen Nespresso machine in one of our Boutiques or have it delivered following payment. Once you have signed a contract for a Nespresso Easy Machine subscription, you cannot exchange the chosen machine for a different one.
You can use your Nespresso credit to buy Nespresso products, either on www.Nespresso.com, via our Customer Relationship Centre, in one of our Nespresso Boutiques or via the Nespresso terminals in Delitraiteur.
5. Monthly Nespresso credit
The Nespresso credit you are entitled to will be added to your Nespresso account every month, within 2 days following receipt of your monthly payment.
Log in to your www.Nespresso.com account to check your available Nespresso credit.
Nespresso reserves the right to interrupt the payment of the additional credit at any time and without any justification.
The Nespresso credit cannot be transferred, returned or exchanged for cash.
6. How do I subscribe to Nespresso Easy ?
Go to our website to subscribe to (and activate) Nespresso Easy. The monthly fee is due from the moment you subscribe. This monthly fee must be paid by credit card. During the subscription process, you will be asked to accept these general terms and conditions as well as our privacy policy. Once Nespresso Easy has been activated and your account has been credited, you will receive a confirmation e-mail.
You can also subscribe and activate Nespresso Easy in one of our boutiques. The monthly fee is due from the moment you subscribe. This monthly fee must be paid by credit card. During the subscription process, you will be asked to accept and sign these general terms and conditions as well as our privacy policy. Once Nespresso Easy has been activated and your account has been credited, you will receive a confirmation e-mail.
The subsequent monthly fees will be paid by credit card. The payment will be processed every month on the day that you activated Nespresso Easy.
7. What if my Nespresso credit is insufficient to cover the price of the minimum order quantity ?
We understand that your Nespresso Easy plan may not always provide the necessary Nespresso credit to buy 50 capsules, the minimum order quantity. If this is the case, you can do the following :
You can use your available Nespresso credit and pay the balance with your credit card.
You can save up your Nespresso credit to order your coffee and your favourite Nespresso accessories at a later stage.
8. Withdrawal period
If you have contracted Nespresso Easy via our website, you have the right to change your mind and withdraw from your Nespresso Easy plan without any justification whatsoever, within a period of 14 days following the activation of the Nespresso Easy plan by yourself or a person designated by you (hereinafter referred to as the " withdrawal period ").
In order to exercise this right, you must inform us of your decision by means of a clear declaration before the expiry of the withdrawal period. You can either use the withdrawal form on the website or contact us by any other means. You can also find our contact details on https://www.Nespresso.com/lu/en/legal.
If you have subscribed to the Nespresso Easy Machine service on www.Nespresso.com, via our Customer Relationship Centre or in one of our Boutiques, you will also need to return the Nespresso machine purchased. If you have subscribed to the Nespresso Easy Machine service in a partner store, you must also return the Nespresso machine purchased in accordance with the regulations of the partner store and prove this by sending us the return slip signed in store as well as the invoice for the Nespresso Easy service.
If you cancel Nespresso Easy before the expiry of the withdrawal period, we will refund all payments you have made, including delivery costs (but excluding additional costs if you had chosen a delivery method other than our cheapest standard delivery method).
We will refund you using the same payment method that you used to pay us. You will not incur any charges for refunds.
You will have to return or give us back the machine and any unused capsules that you had received or that were on their way at the time you informed us that you were exercising your right of withdrawal. Unused products must be properly protected, in their original unopened and intact packaging, in perfect condition, fit for resale, and accompanied by any accessories, instructions for use and documentation, for hygiene and safety reasons. These conditions are cumulative.
Subject to the above, we will refund you immediately and in any case no later than 14 days after receipt of any machines and capsules, or (if earlier) within 14 days of receipt of proof that you have returned any machines and capsules to us. If you withdraw before receiving the capsules, we will refund you within 14 days from the date on which you notify us of your withdrawal from Nespresso Easy. We reserve the right to suspend the refund until we receive any unused machines and capsules.
You lose your right of withdrawal as soon as you open, use or consume a coffee capsule. Nespresso therefore advises you not to open the cardboard packaging containing the products and to handle them with care.
9. What is the duration of Nespresso Easy ?
Nespresso Easy lasts for as long as you pay the monthly fee.
At the end of the subscription period, and unless you notify Nespresso to the contrary before its expiry, the Nespresso Easy service will be tacitly renewed indefinitely under the same conditions.
A subscription to Nespresso Easy Machine has a minimum duration of twelve (12) months. The Nespresso machine purchased when subscribing to the Nespresso Easy Machine service will remain your property.
Please refer to point 11 for the specific termination terms and conditions.
10. Non-payment
If the payment of your monthly contribution fails on the due date, Nespresso will attempt to debit all outstanding amounts on the same payment date the following month. After 2 failed payments, we will attempt to debit all outstanding amounts again on the same payment date the following month.
Nespresso Luxembourg Sàrl will terminate the coffee subscription after three failed payments in three consecutive months. Nespresso will charge a buyout fee for the outstanding payments within your contract. The buyout fee amounts to 50% of the monthly due amounts. For a coffee subscription with a duration of 24 months, we calculate the buyout fee up to the 12th payment. The buyout fee will not be credited to your account as a balance.
11. Termination of your Nespresso Easy subscription
If you wish to terminate Nespresso Easy, please contact the Customer Relationship Centre on 8002 26 33 or visit a Nespresso Boutique. You are not entitled to a refund of the monthly amounts already paid at the time of termination.
If you have a Nespresso Easy Machine subscription and you wish to terminate your subscription before the end of the minimum subscription period of twelve (12) months, contact us on 8002 26 33 or visit one of our Nespresso Boutiques in Luxemburg. Termination is possible from the fourth month after the conclusion of the Nespresso subscription by paying a fine (50% of the outstanding monthly amount of your subscription). If your Nespresso Easy subscription has been continued tacitly under the same conditions for an indefinite period of time after the 12th month, you can terminate your subscription at any time without charge. The coffee machine cannot be returned. Nespresso reserves the right to automatically deduct the amount of the termination fee due from your remaining customer credit.
Nespresso reserves the right to cancel your Nespresso Easy subscription at any time in the event of abuse or non-compliance with these general terms and conditions.
12. Post-termination
Once your subscription has been terminated, you have up to two years following the notification of termination to make purchases with the remaining Nespresso credit. If you have not used your credit balance two years after your last deposit, the credit will expire.
13. Terms and conditions of use
Nespresso reserves the right to modify, periodically and at its sole discretion, the present general terms and conditions relating to Nespresso Easy. In this case, we will duly inform the subscribers of the Nespresso Easy plan concerned by these modifications.
14. Data confidentiality
The (personal) data required to subscribe to Nespresso Easy are processed by Nespresso in accordance with its privacy policy, as detailed on https://www.Nespresso.com/lu/en/legal.
15. News and notifications
Throughout the duration of your Nespresso Easy Coffee and/or Nespresso Easy Machine plan, Nespresso will inform you by e-mail of interesting new features, as well as your available Nespresso credit.
