By taking part in this Nespresso GC 2025 Campaign promotion (“Promotion”), all persons participating herein (“Participants”) agree to be bound by these terms and conditions and the processing of your personal information according to the Privacy Notice at https://www.nespresso.com/my/en/legal.

Nespresso Coffee Promotion Mechanics in Direct Channels (Boutique, Nano Boutiques, Pop-Up Stores, E-comm and CRC)
i. Stand a chance to win RM1,000 worth of Club Credit when you purchase any of the Original Discovery Selection, Original Detective’s Coffee Selection, Original Thief’s Coffee Selection, Vertuo Detective’s Coffee Selection, or Vertuo Thief’s Coffee Selection assortment packs.
ii. 10 lucky scratch cards, with a prize of RM1,000 Club Credit each, have been inserted into the coffee assortment packs stated above. Those who wish to participate will need to search for the scratch card in their purchased assortment pack, and scratch off to reveal the hidden message.
iii. The ten (10) winning cards will reveal a secret code, whereas other cards will have a message encouraging customers to try again. If the customer has a winning card with the secret code, they should then follow the instructions stated on the card to redeem their prize.
iv. The ten (10) winners, who are in possession of the secret code written on the scratch card, must then call the Nespresso Toll-free line at 1800 80 7001, and answer a simple question to redeem the RM1,000 Club Credit.
v. Winners must have a valid Club Member account with Nespresso Malaysia to receive the RM1,000 Club Credit.
vi. Each winner must redeem the RM1,000 Club Credit via the Nespresso Toll-free line by 31st May 2025. After this date, the RM1,000 Club Credit will be void.
vii. Each participant is only eligible to redeem the prize one (1) time. In the event where a participant is in possession of multiple secret codes, the participant will only be able to redeem one (1) prize of RM1,000 in Club Credit.
viii. Once the RM1,000 Club Credit is credited in the winner’s Club Member account, the winner must utilize the RM1,000 Club Credit at the Nespresso Boutique, Nespresso Nano Boutiques, Nespresso Pop-Up Stores, Nespresso website www.nespresso.com, Nespresso Mobile App or Nespresso Toll-free 1800 80 7001 by 31st December 2025, after which, the RM1,000 Club Credit will be void.
ix. The RM1,000 Club Credit is non-refundable and non-transferable, and may neither be exchanged for a cash equivalent, nor used for any cancellation fee, or to purchase any subscription plan (where applicable).
x. The following groups of persons shall not be eligible to participate in this promotion:
- (a) Employees of Nestlé Products Sdn Bhd (Nespresso Malaysia) (“the Organiser”) and its group of companies and their immediate family members (spouse, children, parents, siblings, and their spouses); and
- (b) Employees of the Organiser’s agencies associated with the Promotion and their immediate families (spouse, children, parents, siblings, and their spouses).

- The invalidity, illegality or unenforceability of any terms hereunder shall not affect or impair the continuation in force of the remainder of the terms and conditions of the Promotion.
- This Promotion and the terms of use and all matters arising there from are governed by Malaysia law and each participant agrees to submit to the exclusive jurisdiction of Malaysia courts.

Nespresso Machine Cashback in Coffee Vouchers in Authorised Retailers (Ban Hin Bee Electrical & Sincere Zone Electrical)
i. Customers who purchase a Nespresso Inissia coffee machine or Inissia & Aeroccino3 coffee machine bundle from the participating authorized retailers (as listed in paragraph (iii)) from 1st March 2025 to 31st December 2025 will receive coffee vouchers for future coffee purchases as detailed below: -

- Customers are limited to one (1) purchase of either Type A or Type B coffee machine, per email address, at any one (1) of the participating authorized retailers listed in paragraph (iii) below.
- For example, if a customer purchases one (1) Type A coffee machine at Ban Hin Bee Electrical physical outlet and successfully redeems the coffee vouchers, the said customer with the same email address who purchases either Type A or Type B coffee machines at any of the participating authorized retailers shall not be entitled to any further redemption of coffee vouchers.
- To receive the coffee vouchers, please follow the redemption instructions in paragraph (v) below.
- There must be a minimum purchase of 50 Nespresso Original Coffee Capsules in a single transaction/receipt;
- Vouchers cannot be stacked/combined within the same transaction/receipt, or with any other promotions.

- (e) Machine Serial Number (found on the machine)

ix. Vouchers are valid for 1 year from the date of receipt of the voucher codes. Expired vouchers will be forfeited, and will not be reissued, extended, or refunded.
x. Nespresso Malaysia reserves the right to verify all submissions and request additional information if necessary.
xi. Nespresso Malaysia reserves the right to amend, extend, or terminate the Promotion at any time without prior notice.
xii. Any misuse, fraudulent activity, or violation of these terms will result in the cancellation of vouchers and potential exclusions from future promotions.

- Open to selected Nespresso Members only who have received the special promotional email inviting them to participate in this promotion. Excludes Nestlé and Nespresso employees.
- To qualify for their offer, participating Members must purchase the required number and variety of Nespresso capsules as stated in the promotional message sent directly to them. Such purchases must be made in a single transaction during the stated promotional period.
- The offer will be automatically added to the Member’s account on the date the email is sent and will expire 30 days later. The promotion will apply for purchases made within 30 days of the date of that promotional email. Purchases made after the 30 days will not qualify for the offer.
- The offer is limited to a maximum of one complimentary gift with purchase per participant/ Nespresso Member account throughout the duration of the stated promotional period.

- Nespresso Malaysia, its agents, sponsors and/or representatives shall not be liable to perform any of their obligations in respect of the Promotion and the terms and conditions where they are unable to do so as a result of circumstances beyond their control and shall not be liable to compensate the Participants in any manner whatsoever in such circumstances.
- Nespresso Malaysia is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of, user or member communications, or any problems or technical malfunction of our telecommunications network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet.
- The invalidity, illegality or unenforceability of any terms hereunder shall not affect or impair the continuation in force of the remainder of the terms and conditions of the Promotion.
This Promotion and the terms of use and all matters arising there from are governed by Malaysia law and each participant agrees to submit to the exclusive jurisdiction of Malaysia courts.
These terms and conditions govern your agreement with Nespresso Malaysia for a Nespresso subscription plan. By choosing to purchase a Nespresso subscription plan you accept these supplementary terms and conditions. - How Much is it?
- 1.1Your Nespresso subscription plan has a fixed cost, which will be charged to you through a Monthly Fee. The Monthly Fee is a fixed fee, which varies depending on the subscription plan you select.
- 1.2 The first Monthly Fee will be payable at the time you sign up to the Nespresso subscription plan. The Monthly Fee is to be paid by credit card. The subsequent Monthly Fees will be payable every month on the same day of the month as when your subscription was activated.
- Security Checks
- 2.1 To ensure that your credit card is not being used without your consent, we reserve the right to validate name, address and other personal information supplied by you during the order process against appropriate third party databases. We also reserve the right to perform a credit check. By accepting these supplementary terms and conditions you consent to such checks being made. In performing these checks, personal data provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information.
- What’s Included in the Nespresso Subscription Plan?
- 3.1 In order to purchase a Nespresso subscription plan, you must register as a Nespresso Member. When you purchase a Nespresso subscription plan, you agree to pay the Monthly Fee each month. In return for the Monthly Fee, you can regularly select Nespresso capsules or other products, which you can buy using your Nespresso Credit as described below. As a subscriber, you will also receive extra Nespresso Credit added to your account each month at no charge to you. This credit will be granted each month as soon as your subscription is active.
- Monthly Nespresso Credit:
- 4.1 Each month, you will receive a fixed amount of Nespresso Credit that you can use to purchase Nespresso coffee or accessories on nespresso.com, by phone, or in our Nespresso Boutiques. The amount of Nespresso Credit you receive is equal to the Monthly Fee for the subscription plan you select plus the extra credit that is free of charge to you – so if your Monthly Fee is MYR100, that MYR100 becomes MYR100 credit and in addition, you receive another MYR10 extra credit free of charge to you. Nespresso reserves the right to terminate the payment of the extra credit at any time without any reason.
- 4.2 All of the Nespresso Credit you are eligible to will be added to your Nespresso account that is linked to your Membership each month within 7 days of receipt of the Monthly Fee in cleared funds.
- 4.3 Make sure that you regularly select what goods you would like to purchase using your Nespresso Credit, as your Nespresso Credit will expire two years after the end of the subscription. Any unused Nespresso Credit remaining at the date of expiry will be lost, and you will not receive a refund. You can check your current balance of Nespresso Credit by logging into your account on www.nespresso.com/my/.
- 4.4 Nespresso Credit is non-refundable and non-transferable and may not be exchanged for a cash equivalent, or to purchase any subsequent subscription plan.
- How Long Does the Subscription Last?
- 5.1 The Nespresso subscription plan will go on as long as you continue to make your monthly payments. It can be terminated at any time of your choosing and this, without any penalties for you.
- Terminating Your Subscription
- 6.1 If you wish to terminate your subscription, you may do so by accessing your my account/my subscriptions section on www.nespresso.com/my/ or by contacting our Customer Relationship Centre at 1800 80 7001. You will not be entitled to a refund for any Monthly Fees already paid at the date of termination.
- Failed Payments
- 7.1 If you fail to pay the Monthly Fee when due, Nespresso’s automated system will reattempt again until successful for three consecutive days. Any outstanding balance will be carried forward such that the next payment will be for the previous and current months. Nespresso Malaysia will freeze access to your Nespresso account after two failed monthly payments until such payment is made. Your subscription will hence be terminated. See section 8.1 for what happens to your credit after termination.
- After the Termination
- 8.1After the termination of your subscription, any remaining Nespresso Credit will still be available for you to spend and will not expire until two years after notification of cancellation. Any additional Nespresso Credit that were added to your account each month and at no charge to you will stop.
- Who Can Subscribe?
- 9.1 Customers must be at least 18 years old and reside in Malaysia. There is a limit of one Nespresso subscription plan per Nespresso Member.
- Terms of Use
- 10.1 Nespresso reserves the right to change the subscription terms and condition from time to time and at our sole discretion. Should that be the case, we will provide adequate notification to subscribers affected by any such change.

- These terms and conditions govern your agreement with Nespresso Malaysia for a Nespresso Machine Subscription Plan. By choosing to purchase the Nespresso Machine Subscription Plan you accept these supplementary terms and conditions, in particular the 12-month minimum subscription term (the “Minimum Subscription Term”). These supplementary terms apply in addition to the General Conditions of Sale, which can be accessed at /my/en/legal.
- These terms and conditions may be modified from time to time by posting a new dated version on this website. You are invited to read these terms and conditions on a regular basis to be informed of these modifications. Amendments:
- What are the current participating machines?
Essenza Mini, Essenza Mini Bundle that includes an Aeroccino, Lattissima Touch, Atelier, Vertuo Next and Vertuo Pop. - Who can subscribe?
Customers must be at least 18 years old and reside in Malaysia with a valid local address. There is a limit of one Nespresso subscription plan per Nespresso Member. Employees of Nespresso and its group of companies are not eligible to participate in this plan. -
Do I have to be a Nespresso Club Member to purchase the Nespresso Machine Subscription Plan?
If you are not already a Nespresso Club Member, you will need to register via /my/en/registration or one of our Boutiques to sign up for any of our subscription plans. There is a limit of one Nespresso Machine Subscription Plan per Nespresso Club Member. -
How do the payments work?
- Your Nespresso Machine Subscription Plan has a fixed cost which will be charged to you through a monthly fee that is payable in 12 consequent monthly payments for the duration of the Minimum Subscription Term (“Monthly Fee”). The Monthly Fee is a fixed fee which varies depending on the type of Nespresso Machine Subscription Plan you select (refer to section 6.3 below). There is an additional RM50 nominal charge for a Nespresso machine.
- The first Monthly Fee, plus the RM50 nominal charge for the Machine Subscription Plan, will be payable at the time you sign up to the Nespresso Machine Subscription Plan. You shall pay the Monthly Fee by credit card (see section 11.2 of the General Conditions of Sale for payment information). The subsequent Monthly Fees will be payable every month on the same date of the month as when your subscription was activated.

- How do I purchase the Nespresso Machine Subscription Plan?
- In order to purchase a Nespresso Machine Subscription Plan you must:
a. go to the website /my/en/;
b. click on the link to sign up to the type of machine subscription plan you prefer;
c. complete the machine subscription plan registration form; and
d. agree to the terms and conditions of the machine subscription plan.
- When you purchase a Nespresso Machine Subscription Plan, you agree to pay the Monthly Fee each month for the duration of your subscription. Provided you pass our security and credit checks, the Nespresso machine that goes with your Nespresso Machine Subscription Plan will be dispatched to you upon receipt of your first Monthly Fee in cleared funds. You may not upgrade or change your selected machine during the Minimum Subscription Term.
- In order to purchase a Nespresso Machine Subscription Plan you must:
- Monthly Nespresso Club Credit
- In return for your payment of the Monthly Fee, each month you will receive a fixed amount of the Nespresso Club Credit (as described in section item 6.3 above). The Nespresso Club Credit will be placed in your Nespresso Club Membership account each month within 5 days of receipt of the Monthly Fee in cleared funds. You may use the Nespresso Club Credit to purchase Nespresso coffee, accessories or coffee machines on /my/en/, by phone 1800807001, or in our Nespresso Boutiques/ Nespresso Pop-Up Stores.You can check your current balance of Nespresso Club Credit by logging into your account on /my/en/.
- The Nespresso Club Credit is non-refundable and non-transferable and may neither be exchanged for a cash equivalent nor used for the Cancellation Fee (as described in section 6.3 above) or to purchase any subsequent subscription plan.
- Minimum Subscription Term
The Minimum Subscription Term of 12 months for the Nespresso Machine Subscription Plan begins on the date on which your first Monthly Fee is received in cleared funds. After 12 months, your subscription will be automatically renewed until you decide to cancel it, as set out in section 10 below. -
Cancelling your subscription during the Minimum Subscription Term
If you wish to cancel your subscription before the end of the Minimum Subscription Term you may do so by contacting our Customer Relationship Centre at 1800 80 7001. If you cancel before the Minimum Subscription Term, you will be required to pay the Cancellation Fee (as described in section 6.3 above). You will not be entitled to a refund for any Monthly Fees already paid at the date of cancellation. You will not be able to sign up any new Nespresso subscription plan for 30 days from the date of cancellation. You will not receive any further Nespresso Club Credit as of the date of cancellation. However, upon cancellation, any Nespresso Club Credit that remains on your Nespresso Club Membership account will be available for your use 24 months from the date of the cancellation. -
What happens after the 12-month Minimum Subscription Term?
After the Minimum Subscription Term, your Nespresso Machine Subscription Plan will automatically roll on a month-to-month basis until you cancel it (i.e. you will continue to pay the Monthly Fee each month). By continuing your Machine Subscription Plan with us, Nespresso will credit 10% additional credit on top of your existing plan. Two weeks before the Minimum Subscription Term ends, you will receive an email reminding you that the Minimum Subscription Term is coming to an end.
To cancel, you will need to contact our Customer Relationship Centre at 1800 80 7001. There is no cancellation fee if you cancel after the Minimum Subscription Term. Nespresso reserves the right to continue payments of the initial contractual value on a monthly basis until a notification of cancellation is received. Upon cancellation, any Nespresso Club Credit that remains on your Nespresso Club Membership account will be available for your use 24 months from the date of the cancellation. - Failed Payments
If you fail to pay the Monthly Fee when due, Nespresso’s automated system will reattempt again until successful for three consecutive days. Any outstanding balance will be carried forward such that the next payment will be for the previous and current months. Nespresso Malaysia will freeze access to your Nespresso Club Membership account if the Monthly Fees are outstanding for two months, and your subscription will hence be terminated. You will have to pay the appropriate Cancellation Fee (as set out in section 6.3 above) if the termination takes effect before the end of the Minimum Subscription Term. - Security checks
To ensure that your credit card (VISA/ Master card) is not being used without your consent, we reserve the right to validate name, address and other personal information supplied by you during the order process against appropriate third-party databases. We also reserve the right to perform a credit check. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal data provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. - Use with other offers
This Nespresso Machine Subscription Plan cannot be used in conjunction with any other Nespresso promotion, offer, privileges or discount. At any one time you may only subscribe to one Nespresso Machine Subscription Plan. - Tampering
Nespresso reserves the right to terminate the subscription plan if any individual tampers with the subscription process. Tampering includes but is not limited to the utilisation of techniques designed to avoid payment of the fees owing under this subscription. - Miscellaneous
- You are not allowed to transfer your Nespresso Machine Subscription Plan to another person.
- Nespresso may, without prior notice, terminate the Nespresso Machine Subscription Plan (but this will not affect customers who have already signed up for it).
- Nespresso’s decisions on all matters relating to this Nespresso Machine Subscription Plan are final.
- Governing Law
The present Terms & Conditions and all claims, disputes and controversies of any kind or nature arising in connection with the Nespresso Machine Subscription Plan or your subscription, shall be governed by and construed in accordance with the laws of Malaysia and each party shall submit to the exclusive jurisdiction of the courts of Malaysia.
- Acceptance and Modification of the Terms of Use
- Your access and use of the websites (the “Websites”) of Nestlé Nespresso S.A. (“Nespresso”), which includes Nespresso’s affiliated companies, are governed by the present terms of use (the “Terms of Use”). By accessing, browsing and using our Websites you acknowledge that you have read, understood and accepted, without reserve, these Terms of Use, as modified from time to time by us.

- Overview
'EasyOrder' allows you to reorder and pay for your Nespresso capsules automatically based on a chosen frequency.
The General Conditions of Sale automatically apply to any order placed through EasyOrder. In the event of a conflict between the General Conditions of Sale and the conditions related to EasyOrder, the conditions related to EasyOrder will prevail. - “Your order will ship soon” notification
4 days before your recurrent order is shipped by us, you will receive a written notification via email to inform and remind you of the date of shipment, the details of your Product basket, the total price of your recurrent order and whether any of your selected products is out of stock. - Payment
Payments shall be made by credit card. All recurrent orders will be billed to your credit card on the day of shipment.
In the event that your credit card cannot be charged, Nespresso will place your order on hold and send you a notification that the payment could not be executed. Your order will be shipped upon receipt of your payment. - Modification and Cancellation

Nespresso websites. Consumer-directed websites operated by or for Nespresso, including sites that We operate under our own domains/URLs and mini-sites that We run on third party social networks such as Facebook (“Websites”).
Nespresso mobile sites/apps. Consumer-directed mobile sites or applications operated by or for Nespresso, such as smartphone apps.
E-mail, text and other electronic messages. Electronic communications between you and Nespresso.
Nespresso CRC. Calls to our Customer Relationship Centers (“CRC”).
Nespresso Boutiques. Stores managed by Nespresso.
Offline registration forms. Printed registration and similar forms that We collect via, for example, postal mail, in-store demos, contests and other promotions, or events.
Points of Sales. Demonstrators present in physical third party stores to assist you with the registering of your machine and coffee ordering.
Data from other sources. Third party social networks (e.g. such as Facebook, Google) or market researches (if feedback not provided on an anonymous basis).
Telemetry Data.We may collect certain data captured by Nespresso coffee machines that are connected to wifi. Examples include the machine Serial Number, machine alerts or errors, and the type of coffees prepared by consumers, with the respective date and time.
2. PERSONAL DATA THAT WE COLLECT ABOUT YOU AND HOW WE COLLECT IT
Depending on how you interact with Nespresso (online, offline, over the phone, etc.), We collect various types of information from you, as described below.
Personal contact information. This includes any information you provide to Us that would allow Us to contact you, such as your name, postal address, e-mail address, social network details, or phone number
Account login information. Any information that is required to give you access to your specific account profile. Examples include your login ID/email address, screen name, password in unrecoverable form, and/or security question and answer.
Demographic information & interests. Any information that describes your demographic or behavioural characteristics. Examples include your date of birth, age or age range, gender, geographic location (e.g. postcode/zip code), favorite products, hobbies and interests, and household or lifestyle information.
Technical information about computer/mobile device. Any information about the computer system or other technological device that you use to access one of our Websites or apps, such as the Internet protocol (IP) address used to connect your computer or device to the Internet, operating system type, and web browser type and version. If you access a Nespresso website or app via a mobile device such as a smartphone, the collected information will also include, where permitted, your phone’s unique device ID, advertising ID, geo-location, and other similar mobile device data.
Websites/communication usage information. As you navigate through and interact with our Websites or newsletters, We use automatic data collection technologies to collect certain information about your actions. This includes information such as which links you click on, which pages or content you view and for how long, and other similar information and statistics about your interactions, such as content response times, download errors and length of visits to certain pages. This information is captured using automated technologies such as cookies (browser cookies, flash cookies) and web beacons, and is also collected through the use of third party tracking. You have the right to object to the use of such technologies, for further details please see Section 3.
Market research & consumer feedback. This includes information that you voluntarily share with Us about your experience of using our products and services.
Consumer-generated content.This refers to any content that you create and then share with Us on third-party social networks or by uploading it to one of our Websites or apps, including the use of third-party social network apps such as Facebook. Examples include photos, videos, personal stories, or other similar media or content and posts or PM you can leave on Nespresso social media pages. Where permitted, We collect and publish consumer-generated content in connection with a variety of activities, including contests and other promotions, website community features, consumer engagement, and third-party social networking”.
Third party social network information. This refers to any information that you share publicly on a third party social network or information that is part of your profile on a third party social network (such as Facebook) and that you allow the third party social network to share with Us. Examples include your basic account information (e.g. name, email address, gender, birthday, current city, profile picture, user ID, list of friends, etc.) and any other additional information or activities that you permit the third party social network to share. We receive your third party social network profile information (or parts of it) every time you download or interact with a Nespresso web application on a third party social network such as Facebook, every time you use a social networking feature that is integrated within a Nespresso site (such as Facebook Connect) or every time you interact with Us through a third party social network. To learn more about how your information from a third party social network is obtained by Nespresso, or to opt-out of sharing such social network information, please visit the website of the relevant third party social network.
Payment and Financial information. Any information that We need in order to fulfil an order, or that you use to make a purchase, such as your debit or credit card details (cardholder name, card number, expiration date, etc.) or other forms of payment (if such are made available). In any case, We or our payment processing provider(s) handle payment and financial information in a manner compliant with applicable laws, regulations and security standards such as PCI DSS.
Calls to CRC. Communications with a CRC will be recorded or listened into, in accordance with applicable laws, for local operational needs (e.g. for quality or training purposes). Payment card details are not recorded. Where required by law, you will be informed about such recording at the beginning of your call.
Email.We analyze your interactions with our content (e.g. click through, the opening of email) to provide you with personalized information based on your interests and preferences.
3. COOKIES/SIMILAR TECHNOLOGIES, LOG FILES AND WEB BEACONS

5. DISCLOSURE OF YOUR PERSONAL DATA
In addition to the Nespresso/Nestlé entities or ad-hoc in-country partners (in charge of Nespresso operations) mentioned in the data controllers & contact section (see Section 11), We share you Personal Data with the following types of third party organisation:
Service providers. These are external companies that We use to help Us run our business (e.g. order fulfilment, payment processing, fraud detection and identity verification, website operation, market research companies, support services, promotions, website development, data analysis, CRC, etc.). Service providers, and their selected staff, are only allowed to access and use your Personal Data on Our behalf for the specific tasks that they’ve been requested to carry out, based on our instructions, and are required to keep your Personal Data confidential and secure. Where required by applicable law, you can obtain a list of the providers processing your Personal Data (see Section 11 to contact Us).
Credit reporting agencies/debt collectors. To the extent permitted by applicable law, credit reporting agencies and debt collectors are external companies that We use to help Us to verify your creditworthiness (in particular for orders with invoice) or to collect outstanding invoices.
Third party companies using Personal Data for their own marketing purposes. Except in situations where you have given your consent, We do not license or sell your Personal Data to third party companies for their own marketing purposes. Their identity will be disclosed at the time your consent is sought.
Third party recipients using Personal Data for legal reasons or due to merger/acquisition. We will disclose your Personal Data to third parties for legal reasons or in the context of an acquisition or a merger (see Section 4 for details).
6. RETENTION OF YOUR PERSONAL DATA
In accordance with applicable laws, We will use your Personal Data for as long as necessary to satisfy the purposes for which your Personal Data was collected (as described in Section 4 above) or to comply with applicable legal requirements.
Personal data used to provide you with a personalized experience (see Section 4 above for details) will be kept for a duration permitted by applicable laws
7.DISCLOSURE, STORAGE AND/OR TRANSFER OF YOUR PERSONAL DATA
We use a variety of reasonable measures (described below) to keep your Personal Data confidential and secure. Please note, however, that these protections do not apply to information you choose to share in public areas such as third party social networks.
People who can access your Personal Data. Your Personal Data will be processed by our authorised staff or agents, on a need to know basis, depending on the specific purposes for which your Personal Data have been collected (e.g. our staff in charge of customer care matters will have access to your customer record).
Measures taken in operating environments. We store your Personal Data in operating environments that use reasonable security measures to prevent unauthorised access. We follow reasonable standards to protect Personal Data. The transmission of information via the Internet is, unfortunately, not completely secure and although We will do our best to protect your Personal Data, We cannot guarantee the security of the data during transmission through our Websites/apps.
Measures We expect you to take. It is important that you also play a role in keeping your Personal Data safe and secure. When signing up for an online account, please be sure to choose an account password that would be difficult for others to guess and never reveal your password to anyone else. You are responsible for keeping this password confidential and for any use of your account. If you use a shared or public computer, never choose to have your login ID/email address or password remembered and make sure to log out of your account every time you leave the computer. You should also make use of any privacy settings or controls We provide you in our Website/app.
Transfer of your Personal Data. The storage as well as the processing of your Personal Data as described above require that your Personal Data are ultimately transferred/transmitted to, and/or stored at, a destination outside of your country of residence, notably Switzerland and Luxembourg. We will also transfer your Personal Data to countries outside the European Economic Area (“EEA”) (e.g. other Nespresso/Nestlé entities or ad-hoc in-country partners) including to countries which have different data protection standards to those which apply in the EEA. We (i) have put in place European Commission approved standard contractual clauses to protect your Personal Data (and you have a right to ask Us for a copy of these clauses(by contacting Us as set out below) and/or (ii) will rely on your consent (where permitted by law).
8. ACCESS TO YOUR PERSONAL DATA
Access to Personal Data. Where provided by law, you, your successors, representatives and/or proxies have the right to access, review and request a physical or electronic copy of information held about you. You also have the right to request information on the source of your Personal Data.

Please note that any identification information provided to Us will only be processed in accordance with, and to the extent permitted by applicable laws.
Additional rights (e.g. modification, deletion of Personal Data). Where provided by law, you, your successors, representatives and/or proxies can (i) request deletion, the portability, correction or revision of your Personal Data; (ii) oppose the data processing; (iii) limit the use and disclosure of your Personal Data; and (iv) revoke consent to any of our data processing activities.
Please note that, in certain circumstances, We will not be able to delete your Personal Data without also deleting your user account. We may be required to retain some of your Personal Data after you have requested deletion, to satisfy our legal or contractual obligations. We may also be permitted by applicable laws to retain some of your Personal Data to satisfy our business needs.
Where available, our Websites have a dedicated feature through which you can review and edit the Personal Data that you have provided. Please note that We require our registered consumers to verify their identity (e.g. login ID/email address, password) before they can access or make changes to their account information. This helps prevent unauthorised access to your account.

If you decide that you no longer wish to receive such communications, you can subsequently unsubscribe from receiving marketing-related communications at any time, by following the instructions provided in each such communication. To opt-out of marketing communications sent by any medium, including third party social networks, you can opt-out at any time by logging into the Websites/apps or third party social networks and adjusting your user preferences in your account profile by unchecking the relevant boxes or by calling our CRC. Please note that, even if you opt-out from receiving marketing communications, you will still receive administrative communications from Us, such as order or other transaction confirmations, notifications about your account activities (e.g. account confirmations, password changes, etc.), and other important non marketing related announcements.

1. SUMBER DATA PERIBADI
Notis ini terpakai kepada Data Peribadi yang Kami kumpul daripada anda melalui cara-cara yang diterangkan di bawah (rujuk Seksyen 2), daripada sumber-sumber berikut:
Laman web Nespresso. Laman web pengguna yang dikendalikan oleh, atau untuk Nespresso, termasuk laman web yang dikendalikan di bawah domain Kami sendiri/ URL dan laman web mini Kami di bawah rangkaian sosial pihak ketiga seperti Facebook ("Laman Web").
Laman Mobil/aplikasi mudah alih Nespresso Laman web/aplikasi mudah alih Nespresso untuk pengguna yang dikendalikan oleh atau untuk Nespresso seperti aplikasi telefon pintar.

Maklumat teknikal mengenai komputer/peranti mudah alih. Sebarang maklumat berkenaan sistem komputer atau peranti teknologi lain yang anda gunakan untuk mengakses salah satu daripada laman web atau aplikasi Kami, seperti Protokol Internet (IP) yang digunakan untuk menyambung komputer atau peranti anda dengan Internet, jenis sistem pengendalian dan jenis pelayar web dan versinya. Sekiranya anda mengakses laman web atau aplikasi Nespresso melalui peranti mudah alih seperti telefon pintar, maklumat yang dikumpul sekiranya dibenarkan, ID peranti unik telefon anda, ID pengiklanan, geo-lokasi, dan lain-lain data peranti mudah alih yang sama.
Laman web/maklumat penggunaan komunikasi. Semasa anda melayari dan berinteraksi dengan laman web kami atau surat berita, teknologi pengumpulan data automatik akan digunakan untuk mengumpul maklumat tertentu berkenaan tindakan anda. Ini termasuk maklumat seperti rangkaian manakah yang anda klik, laman atau kandungan manakah yang anda lihat dan untuk berapa lama, dan maklumat lain yang serupa dan statistik tentang interaksi anda seperti masa-masa respon kandungan, kesilapan muat turun dan tempoh lawatan ke halaman tertentu. Kandungan Janaan-Pengguna. Ia merujuk kepada mana-mana kandungan yang dibuat dan dikongsi melalui rangkaian sosial pihak ketiga atau dimuat naik di salah satu laman web atau aplikasi kami termasuk rangkaian sosial seperti Facebook. Contohnya, gambar, video, cerita peribadi, media atau kandungan lain yang serupa dan hantaran atau Mesej Peribadi yang ditinggalkan di laman media sosial Nespresso. Maklumat rangkaian sosial pihak ketiga. Ini merujuk kepada apa-apa maklumat yang dikongsikan secara terbuka oleh anda di rangkaian sosial pihak ketiga atau maklumat yang merupakan sebahagian daripada profil anda di rangkaian sosial pihak ketiga (seperti Facebook) dan di mana anda membenarkan rangkaian sosial pihak ketiga untuk berkongsi dengan Kami. Maklumat Pembayaran dan Kewangan. Sebarang maklumat yang Kami perlukan untuk memenuhi pesanan atau yang anda gunakan untuk membuat pembelian seperti butiran debit atau kad kredit (nama pemegang kad, nombor kad, tarikh luput, dan lain-lain) atau lain-lain bentuk pembayaran (seperti yang disediakan). 5. PENDEDAHAN DATA PERIBADI ANDA
Selain entiti-entiti Nespresso/Nestlé atau rakan kongsi dalam negara (yang bertanggungjawab bagi operasi Nespresso) yang dinyatakan di seksyen pengawal & hubungi kami (lihat Seksyen 11), Kami berkongsi Data Peribadi anda dengan organisasi pihak ketiga berikut:
Pembekal perkhidmatan. Ini adalah syarikat-syarikat luar yang Kami gunakan untuk membantu menjalankan perniagaan kami (cth. memenuhi pesanan, proses pembayaran, pengesanan penipuan dan pengesahan identiti, operasi laman web, syarikat penyelidikan pasaran, perkhidmatan sokongan, promosi, pembangunan laman web, analisis data, CRC, dan lain-lain). Pembekal perkhidmatan dan kakitangan yang terpilih hanya dibenarkan untuk mengakses dan menggunakan Data Peribadi anda bagi pihak Kami untuk tugas-tugas tertentu yang diminta untuk dijalankan berdasarkan arahan Kami dan dikehendaki menyimpan Data Peribadi anda secara sulit dan selamat. Seperti yang diperuntukkan undang-undang, anda boleh mendapatkan senarai pembekal-pembekal yang memproses Data Peribadi anda (lihat Seksyen 11 untuk menghubungi Kami).
Agensi laporan kredit / pemungut hutang. Setakat yang dibenarkan oleh undang-undang, agensi pelaporan kredit dan pemungut hutang adalah syarikat-syarikat luar yang Kami gunakan untuk membantu Kami mengesahkan kelayakan kredit anda (khususnya untuk pesanan dengan invois) atau untuk mengumpul invois tertunggak.
Syarikat-syarikat pihak ketiga yang menggunakan Data Peribadi anda untuk tujuan pemasaran mereka sendiri. Kecuali dalam situasi di mana anda telah memberi kebenaran, Kami tidak melesenkan atau menjual Data Peribadi anda kepada syarikat-syarikat pihak ketiga untuk tujuan pemasaran mereka sendiri. Identiti mereka akan didedahkan semasa mendapatkan kebenaran anda.
Penerima-penerima pihak ketiga menggunakan Data Peribadi atas sebab-sebab undang-undang atau disebabkan oleh penggabungan/pengambilalihan. Kami akan mendedahkan Data Peribadi anda kepada pihak ketiga atas sebab-sebab undang-undang atau dalam konteks suatu pemerolehan atau penggabungan (lihat Section 4 untuk maklumat lanjut).
6. PENYIMPANAN DATA PERIBADI ANDA
Seperti yang diperuntukkan undang-undang, Kami akan menggunakan Data Peribadi anda untuk tempoh selama yang perlu bagi memenuhi tujuan di mana Data Peribadi anda dikumpulkan (seperti yang dinyatakan di Seksyen 4 di atas) atau untuk mematuhi keperluan undang-undang yang berkenaan.
Data peribadi yang digunakan untuk menyediakan anda dengan pengalaman peribadi (lihat Seksyen 4 di atas untuk maklumat lanjut) akan disimpan untuk tempoh selama yang dibenarkan oleh undang-undang.
7. PENDEDAHAN, PENYIMPANAN DAN/ATAU PEMINDAHAN DATA PERIBADI ANDA
Kami menggunakan pelbagai langkah-langkah yang munasabah (seperti yang diterangkan di bawah) untuk menyimpan Data Peribadi anda secara rahsia dan selamat. Sila ambil perhatian, bagaimanapun, perlindungan ini tidak terpakai kepada maklumat yang anda kongsi di tempat awam seperti rangkaian sosial pihak ketiga.

Penghantaran maklumat melalui Internet, malangnya, adalah tidak sepenuhnya selamat dan walaupun Kami akan melakukan yang terbaik untuk melindungi maklumat peribadi anda, kami tidak dapat menjamin keselamatan data semasa penghantaran melalui laman web/aplikasi Kami.

Pemindahan Data Peribadi anda. Penyimpanan serta pemprosesan Data Peribadi anda seperti yang diterangkan di atas memerlukan Data Peribadi anda dipindahkan/dihantar kepada, dan/atau disimpan di destinasi luar dari negara tempat tinggal anda terutamanya Switzerland dan Luxembourg. Kami juga akan memindahkan Data Peribadi anda ke negara-negara yang berada di luar Kawasan Ekonomi Eropah (Europian Economic Area) ("EEA") (cth. Nespresso lain/entiti-entiti Nestlé atau rakan kongsi dalam negara) termasuklah ke negara-negara yang mempunyai standard perlindungan data yang berlainan daripada yang terpakai di EEA. Kami (i) telah meletakkan standard klausa kontrak yang diperakui Suruhanjaya Eropah untuk melindungi Data Peribadi anda (dan anda mempunyai hak untuk meminta salinan klausa tersebut daripda Kami (dengan menghubugi Kami seperti di bawah) dan/atau (ii) akan bergantung di atas kebenaran anda (di mana dibenarkan oleh undang-undang).
8. AKSES KEPADA DATA PERIBADI ANDA
Akses kepada Data Peribadi. Seperti mana yang diperuntukkan undang-undang, anda, pengganti, wakil dan/atau proksi anda mempunyai hak untuk mengakses, dan meminta maklumat salinan fizikal atau elektronik tentang anda. Anda juga mempunyai hak untuk meminta maklumat mengenai sumber Data Peribadi anda.

Hak-hak lain (cth. Pengubahsuaian, pemadaman Data Peribadi). Seperti mana yang diperuntukkan undang-undang, anda, pengganti, wakil dan / atau proksi anda boleh (i) meminta pemadaman, pembetulan atau semakan Data Peribadi anda; (ii) menentang pemprosesan data; (iii) menghadkan penggunaan dan pendedahan Data Peribadi anda; dan (iv) membatalkan kebenaran kepada mana-mana aktiviti pemprosesan data Kami.
Sila ambil perhatian, dalam keadaan tertentu, kami mungkin tidak dapat memadam Data Peribadi anda tanpa memadam akaun pengguna anda. Kami juga mungkin perlu mengekalkan sebahagian daripada Data Peribadi yang anda pohon untuk dipadamkan bagi memenuhi tanggungjawab undang-undang atau kontrak Kami. Anda mengurus kebenaran anda melalui (i) solusi pengurusan kebenaran Kami atau (ii) anda boleh menetapkan pelayar anda untuk tidak menerima semua atau sebahagian cookies pelayar atau memberi amaran kepada anda apabila cookies sedang digunakan. Pengiklanan, pemasaran dan promosi. Sekiranya anda ingin Nespresso berkongsi promosi produk dan perkhidmatan Kami melalui Data Peribadi yang diberikan, anda boleh menanda kotak yang terletak pada borang pendaftaran atau dengan menjawab soalan disampaikan oleh kakitangan pemasaran, CRC atau wakil-wakil butik kami. Jika anda memutuskan bahawa anda tidak lagi mahu menerima komunikasi tersebut, anda boleh berhenti melanggan daripada menerima komunikasi yang berkaitan pemasaran pada bila-bila masa, dengan mengikuti arahan yang diberikan dalam setiap komunikasi tersebut. Untuk memilih keluar komunikasi pemasaran yang dihantar oleh mana-mana medium termasuk rangkaian sosial pihak ketiga, anda boleh memilih untuk keluar pada bila-bila masa dengan melayari ke dalam laman web/aplikasi dan menyesuaikan profil akaun anda dengan tidak menandakan kotak berkenaan atau dengan menghubungi CRC kami. Jika anda memutuskan bahawa anda tidak lagi ingin mendapatkan manfaat daripada ini, anda boleh memilih untuk keluar pada bila-bila masa dengan melayari ke dalam laman web/aplikasi dan menyesuaikan laman keutamaan dalam profil akaun anda dengan tidak menandakan kotak berkenaan atau dengan menghubungi CRC kami.
10. PERUBAHAN NOTIS KAMI
Sekiranya Kami mengubah cara Kami mengendalikan Data Peribadi anda, Kami akan mengemas kini Notis ini. Kami mempunyai hak untuk membuat perubahan kepada amalan kami dan Notis ini pada bila-bila masa, sila semak dengan kerap untuk melihat kemas kini Notis Kami.

These Rules govern your conduct, agreement and the rights of Nespresso Malaysia and its affiliates (“Nespresso”) as relates to the Consumer Ratings and Review Service offered by Sprinklr (the "Service"). By submitting any Content to the Service, you agree to the following Rules. As used herein, Content means any text, photo, video, likeness or other material or information you provide to the Service.
These supplementary terms apply in addition to the General Terms of Use and Privacy Policy, which can be accessed at www.Nespresso.com/my/en/legal. If there is an inconsistency between these Rules, the General Terms of Use and Privacy Policy, these Rules will prevail for the Service in preference to the General Terms of Use and Privacy Policy.
If you do not agree to these Rules, please do not use the Service.
You agree that:
- If you have received prior payment or promise of payment in return for your proposed submission; or if you have received an incentive such as free product, discounts, gifts, sweepstakes entries, you will disclose it in your submission;
- If you are a Nespresso employee, you have disclosed that relationship; and
- You do not work for any company or agency hired by Nespresso to promote and/or sell Nespresso’s products.
Submission of Content to the Service
You agree that:
- All Content and information about yourself that you submit is accurate, up to date, reflects your true opinion, and are based upon your actual experience with the product being reviewed;
- The Content you submit is original and was created by you;
- all "moral rights" that you may have in the Content have been voluntarily waived by you;
- Nespresso may use the Content for promotional and other purposes as set forth in these Rules and you will not be entitled to any compensation for such use.
You further agree that you shall not submit any Content that:
- Is known by you to be false, inaccurate or misleading;
- Infringes any third party’s copyright, patent, trademark, trade secret, rights of publicity, rights of privacy, moral rights or any other applicable personal or proprietary rights;
- Encourages or advocates any unlawful or unauthorized behavior or activity, or that violates any law, statute, ordinance or regulation;
- Is offensive, obscene, vulgar, or is inappropriate for a public, family friendly, and pet-friendly forum;
- Is, or may be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, threatening or harassing to any individual or entity;
- Includes any information that references third party websites, addresses, email addresses, contact information or phone numbers; or
- Contains any computer viruses, worms, Trojan horses or other potentially damaging computer programs or files.
Monitor
All Content that you submit may be used at Nespresso’s sole discretion. Nespresso reserves the right, but not the obligation, to:
- Monitor or review the Content you have submitted; - Condense, remove or refuse to post any Content submitted to the Service that Nespresso deems in its sole discretion to be inappropriate or to violate any of these Rules, without giving you notice; and
- Suspend or terminate your access to the Services as Nespresso may deem appropriate.
Nespresso does not guarantee that you will have any recourse through Nespresso to edit or delete any Content you have submitted. Ratings and written comments are generally posted in the next days. However, Nespresso has the right to remove or refuse to post any submission for any reason. You acknowledge that you, not Nespresso, are responsible for the Contents of your submission. None of the Content that you submit shall be subject to any obligation of confidence on the part of Nespresso, its agents, subsidiaries, affiliates, or third party service providers and their respective directors, officers and employees.
License to Use Content
By uploading or submitting any Content to the Service, you automatically grant Nespresso a world-wide, non-exclusive, royalty-free, irrevocable, transferrable, perpetual and sub-licensable license to publicly display or re-display, use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or distribute such Content and/or incorporate such Content into any form, medium or technology whatsoever (including but not limited to Nespresso, websites, third party websites, online and off line advertising, marketing and promotional materials) throughout the world that is used by Nespresso or its agents in connection with the Service or the promotion or marketing of Nespresso, and its products and services.
You represent and warrant to Nespresso that you own all Content and/or have the unencumbered legal right to grant the above-referenced license to Nespresso, with respect to all Content that you submit. You also represent that such materials do not infringe on any third party copyrights or other third party intellectual property rights.
Release and Indemnification
You agree to release, indemnify and hold Nespresso, its parents, affiliated and subsidiary companies (and their respective officers, directors, agents, employees, and agents) harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown including reasonable attorneys’ fees, arising out of or in connection with any breach of your representations and warranties set forth above, any breach of these Rules, or your violation of any law or rights of a third party.
Use of Your Email Address and Telephone Number
By submitting your email address and telephone number in connection with your rating and review, you agree that Nespresso and its third party service providers may use your email address and telephone number to contact you about the status of your review and for other administrative purposes.
Changes to the Rules
Nespresso reserves the right to modify or terminate the Service and these Rules for any reason, without notice, and without liability to you, or any third party. You are responsible for regularly reviewing these Rules so that you are apprised of any changes.
