1. Acceptance and Modification of the Terms of Use
1.1 Your access and use of the websites (the “Websites”) of Nestlé Nespresso S.A. (“Nespresso”), which includes Nespresso’s affiliated companies, are governed by the present terms of use (the “Terms of Use”). By accessing, browsing and using our Websites you acknowledge that you have read, understood and accepted, without reserve, these Terms of Use, as modified from time to time by us.
1.2 If we decide to modify our Terms of Use, we will post a new dated version on our Websites. Therefore, we invite you to consult these Terms of Use from time to time in order to familiarise yourself with any changes.2. Copyright and Intellectual Property
2.1 The content of our Websites and namely but not exclusively the texts, marks, logos, diagrams, photographs, videos, sounds, music, layout, designs, know-how, technologies, products, and processes are the property of Nespresso or its affiliated companies or are used with the authorisation of the owners, and accordingly are protected by copyright, trademarks, patents and all other intellectual or industrial property rights which exist under applicable law.
2.2 Except as provided in Section 3 hereinafter, nothing contained on our Websites shall be interpreted or construed as granting you a license or a right to use any such content of our Websites.3. Use of the Websites
3.1 You may download, display or print the content of our Websites solely for personal, non-commercial use, thereby retaining and reproducing each and every copyright notice or other proprietary rights notice contained in any information or other material you download. Any other use, including the reproduction, modification, distribution, transmission, or broadcast of the content of the Websites, in whole or in part and by any means, is strictly prohibited, except upon prior written consent of Nespresso.
3.2 Nespresso neither warrants nor represents that your use of any content displayed on its Websites will not infringe rights of third parties.4. Information Deemed Non-Confidential
4.1 Any personally identifying data and information that you may send via the Internet to our Websites are protected and treated according to our Privacy Policy (link). Nespresso invites you to read such Privacy Policy carefully before providing us with any such personally identifying data and information.
4.2 Any other information or material communicated to Nespresso through the Internet, by electronic mail or otherwise, including any data, questions, comments, suggestions, ideas, graphics or the like, are and will be treated as non-confidential and non-proprietary. Anything you transmit or post becomes the property of Nespresso and may be freely used for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. Specifically, Nespresso is free to use any ideas, concepts, know-how, or techniques contained in any such communication you send to the Websites for any purpose whatsoever, including, but not limited to, developing, manufacturing, advertising and marketing products using such information. Any such use is without compensation to those providing the information, nor anyone else.
4.3 By submitting information, you are warranting that you own the material/content submitted, that it is not defamatory, and that Nespresso’s use will not violate any third party’s rights. Nespresso is under no obligation to use the information provided.5. Disclaimer of Warranties

6.3 ALL MATERIALS WHICH ARE DOWNLOADED OR OBTAINED BY ANY OTHER MANNER DURING THE USE OF OUR WEBSITES ARE AT YOUR OWN RISK AND PERIL. Nespresso assumes no liability for any damage or virus which could affect your computer equipment or other property by reason of your access to, use or downloading of any material from its Websites or for any illegal intrusion or intervention in the IT systems.
6.4 Nespresso reserves the right to interrupt or discontinue any or all of the functionality of its Websites. Nespresso accepts no responsibility or liability whatsoever for any interruption or discontinuance of any or all functionality of its Websites resulting from actions or omissions of Nespresso or any third party.7. Change of Information
The content of our Websites may contain inaccuracies or errors. Nespresso reserves the right to make changes, corrections and/or improvements to such content any time without prior notice but does not assume any responsibility to do so.8. Availability of Products / Services
Our Websites may contain information on Nespresso’s worldwide products and services, not all of which are available in every location. A reference to a Nespresso product or service on the Websites does not imply that such product or service is or will be available at your location.9. Links
9.1 As a service to our visitors, our Websites may contain hypertext links leading to other websites that are not operated or controlled by Nespresso. Nespresso shall not be considered as responsible for these sites and declines all responsibility and liability in relation to their content, legality, accuracy or functions.
9.2 The creation of any hyperlink to our Websites is prohibited without prior written consent of Nespresso.10. Miscellaneous
10.1 The present Terms of Use embody the entire agreement concluded between Nespresso and yourself concerning the access and the use of the Websites and their content. Any other terms or conditions issued by Nespresso and governing its relations with you, in particular relating to any service or purchase of product, shall supplement the Terms of Use; in the event of any inconsistency between them, the other terms or conditions shall prevail over these Terms of Use.
10.2 The fact that Nespresso tolerates a violation by yourself of one of the obligations set out in the Terms of Use, or does not enforce a right attributed to it thereunder or under the law shall not be construed as a waiver by it to invoke and enforce its rights.
10.3 In the event that any provision of the Terms of Use is considered to be illegal by law or regulation, existing or future, or by a court ruling, then such provision shall be considered as stricken, all other provisions of the Terms of Use maintaining full force and effect between yourself and Nespresso.

SCOPE OF THIS NOTICE
Please read this privacy notice (“Notice”) carefully to understand our policies and practices regarding your Personal Data and how we will treat it.
This Notice explains how your Personal Data are collected, used, and disclosed by Nestlé Nespresso entities as listed in the controllers & contact section (Section 11) (“Nespresso”, “We”, Us”). It also tells you how you can access and update your Personal Data and make certain choices about how your Personal Data are used.
This Notice covers both our online and offline data collection activities, including Personal Data that We collect through our various channels such as websites, apps, third party social networks, Customer Relationship Centers, Boutiques, points of sales and events. Please note that We combine Personal Data that We collect via one method (e.g. a Nespresso website) with Personal Data that We collect via another method (e.g. a Nespresso offline event). As part of this, We combine Personal Data that were originally collected by different Nestlé Nespresso entities. Please see Section 8 for further information on how to object to this.
If you fail to provide necessary Personal Data to us (We will indicate to you when this is the case, for example, by making this information clear in our registration forms), We may not be able to provide you with our goods and/or services. This Notice can change from time to time (see Section 10).

1. SOURCES OF PERSONAL DATA
This Notice applies to Personal Data that We collect from or about you, through the methods described below (see Section 2), from the following sources:
Websites. Consumer-directed websites operated by or for Nespresso, including sites that We operate under our own domains/URLs and mini-sites that We run on third party social networks such as Facebook (“Websites”).
Mobile sites/apps. Consumer-directed mobile sites or applications operated by or for Nespresso, such as smartphone apps.
E-mail, text and other electronic messages. Electronic communications between you and Nespresso.
CRC.Calls to our Customer Relationship Centers (“CRC”).
Boutiques. Stores managed by Nespresso.
Offline registration forms. Printed registration and similar forms that We collect via, for example, postal mail, in-store demos, contests and other promotions, or events.
Points of Sales. Demonstrators present in physical third party stores to assist you with the registering of your machine and coffee ordering.
Data from other sources.Third party social networks (e.g. such as Facebook, Google) or market researches (if feedback not provided on an anonymous basis).
Telemetry Data. We may collect certain data captured by Nespresso coffee machines that are connected to wifi. Examples include the machine Serial Number, machine alerts or errors, and the type of coffees prepared by consumers, with the respective date and time.
2.PERSONAL DATA THAT WE COLLECT ABOUT YOU AND HOW WE COLLECT IT
Depending on how you interact with Us (online, offline, over the phone, etc.), We collect various types of information from you, as described below.
Personal contact information.This includes any information you provide to Us that would allow Us to contact you, such as your name, postal address, e-mail address, social network details, or phone number
Account login information. Any information that is required to give you access to your specific account profile. Examples include your login ID/email address, screen name, password in unrecoverable form, and/or security question and answer.
Demographic information & interests. Any information that describes your demographic or behavioural characteristics. Examples include your date of birth, age or age range, gender, geographic location (e.g. postcode/zip code), favorite products, hobbies and interests, and household or lifestyle information.
Technical information about computer/mobile device. Any information about the computer system or other technological device that you use to access one of our Websites or apps, such as the Internet protocol (IP) address used to connect your computer or device to the Internet, operating system type, and web browser type and version. If you access a Nespresso website or app via a mobile device such as a smartphone, the collected information will also include, where permitted, your phone’s unique device ID, advertising ID, geo-location, and other similar mobile device data.
Websites/communication usage information. As you navigate through and interact with our Websites or newsletters, We use automatic data collection technologies to collect certain information about your actions. This includes information such as which links you click on, which pages or content you view and for how long, and other similar information and statistics about your interactions, such as content response times, download errors and length of visits to certain pages. This information is captured using automated technologies such as cookies (browser cookies, flash cookies) and web beacons, and is also collected through the use of third party tracking. You have the right to object to the use of such technologies, for further details please see Section 3.
Market research & consumer feedback. This includes information that you voluntarily share with Us about your experience of using our products and services.
Consumer-generated content. This refers to any content that you create and then share with Us on third party social networks or by uploading it to one of our Websites or apps, including the use of third party social network apps such as Facebook. Examples include photos, videos, personal stories, or other similar media or content and posts or PM you can leave on Nespresso social media pages. Where permitted, We collect and publish consumer-generated content in connection with a variety of activities, including contests and other promotions, website community features, consumer engagement, and third party social networking.
Third party social network information. This refers to any information that you share publicly on a third party social network or information that is part of your profile on a third party social network (such as Facebook) and that you allow the third party social network to share with Us. Examples include your basic account information (e.g. name, email address, gender, birthday, current city, profile picture, user ID, list of friends, etc.) and any other additional information or activities that you permit the third party social network to share. We receive your third party social network profile information (or parts of it) every time you download or interact with a Nespresso web application on a third party social network such as Facebook, every time you use a social networking feature that is integrated within a Nespresso site (such as Facebook Connect) or every time you interact with Us through a third party social network. To learn more about how your information from a third party social network is obtained by Nespresso, or to opt-out of sharing such social network information, please visit the website of the relevant third party social network.
Payment and Financial information. Any information that We need in order to fulfil an order, or that you use to make a purchase, such as your debit or credit card details (cardholder name, card number, expiration date, etc.) or other forms of payment (if such are made available). In any case, We or our payment processing provider(s) handle payment and financial information in a manner compliant with applicable laws, regulations and security standards such as PCI DSS.
Calls to CRC. Communications with a CRC will be recorded or listened into, in accordance with applicable laws, for local operational needs (e.g. for quality or training purposes). Payment card details are not recorded. Where required by law, you will be informed about such recording at the beginning of your call.
3. COOKIES/SIMILAR TECHNOLOGIES, LOG FILES AND WEB BEACONS
Cookies/Similar Technologies. Please see our Cookie Notice to learn how you can manage your cookie settings and for detailed information on the cookies We use and the purposes for which We use them.
Log Files. We collect information in the form of log files that record website activity and gather statistics about your browsing habits. These entries are generated automatically, and help Us to troubleshoot errors, improve performance and maintain the security of our Websites.
Web Beacons. Web beacons (also known as “web bugs”) are small strings of code that deliver a graphic image on a web page or in an email for the purpose of transferring data back to Us. The information collected via web beacons will include information such as IP Address, as well as information about how you respond to an email campaign (e.g. at what time the email was opened, which links you click on in the email, etc.). We will use web beacons on our Websites or include them in e-mails that We send to you. We use web beacon information for a variety of purposes, including but not limited to, site traffic reporting, unique visitor counts, advertising, email auditing and reporting, and personalisation.
4.USES MADE OF YOUR PERSONAL DATA
The following paragraphs describe the various purposes for which We collect and use your Personal Data, and the different types of Personal Data that are collected for each purpose. Please note that not all of the uses below will be relevant to every individual.
What We use your Personal Data for:
Customer service.
We use your Personal Data for customer service purposes, including responding to your enquiries. This typically requires the use of certain personal contact information and information regarding the reason for your inquiry (e.g. order status, technical issue, product question/complaint, relayed via our communication channels or social media for instance, general question, etc.).

With your consent (where required), We use your Personal Data to provide you with information about goods or services (e.g. marketing communications or campaigns or promotions). This can be done via means such as email, ads, SMS, phone calls and postal mailings to the extent permitted by applicable laws. Some of our campaigns and promotions are run on third party websites and/or social networks. This use of your Personal Data is voluntary, which means that you can oppose (or withdraw your consent in certain countries) to the processing of your Personal Data for this purposes. With your consent (where required), We use your Personal Data (i) to analyse your preferences and habits, (ii) to anticipate your needs based on our analysis of your profile, (iii) to improve and personalise your experience on our Websites and apps; (iv) to ensure that content from our Websites/apps is optimised for you and for your computer or device; (v) to provide you with targeted advertising and content, and (vi) to allow you to participate in interactive features, when you choose to do so. For example, We remember your login ID/email address or screen name so that you can quickly login the next time you visit our site or so that you can easily retrieve the items you previously placed in your shopping cart. Based on this type of information, and with your consent (where required), We also show you specific Nespresso content or promotions that are tailored to your interests. The use of your Personal Data is voluntary, which means that you can oppose the processing of your Personal Data for this purpose. In the event that Nespresso or its assets are acquired by, or merged with, another company including through bankruptcy, we will share your Personal Data with any of our legal successors. We will also disclose your Personal Data to third parties (i) when required by applicable law; (ii) in response to legal proceedings; (iii) in response to a request from a competent law enforcement agency; (iv) to protect our rights, privacy, safety or property, or the public; or (v) to enforce the terms of any agreement or the terms of our Website.

In addition to the Nespresso/Nestlé entities or ad-hoc in-country partners (in charge of Nespresso operations) mentioned in the data controllers & contact section (see Section 11), We share you Personal Data with the following types of third party organization:
Service providers. These are external companies that We use to help Us run our business (e.g. order fulfilment, payment processing, fraud detection and identity verification, website operation, market research companies, support services, promotions, website development, data analysis, CRC, etc.). Service providers, and their selected staff, are only allowed to access and use your Personal Data on Our behalf for the specific tasks that they’ve been requested to carry out, based on our instructions, and are required to keep your Personal Data confidential and secure. Where required by applicable law, you can obtain a list of the providers processing your Personal Data (see Section 11 to contact Us).
Credit reporting agencies/debt collectors. To the extent permitted by applicable law, credit reporting agencies and debt collectors are external companies that We use to help Us to verify your creditworthiness (in particular for orders with invoice) or to collect outstanding invoices.
Third party companies using Personal Data for their own marketing purposes. Except in situations where you have given your consent, We do not license or sell your Personal Data to third party companies for their own marketing purposes. Their identity will be disclosed at the time your consent is sought.
Third party recipients using Personal Data for legal reasons or due to merger/acquisition. We will disclose your Personal Data to third parties for legal reasons or in the context of an acquisition or a merger (see Section 4 for details).
6.RETENTION OF YOUR PERSONAL DATA
In accordance with applicable laws, We will use your Personal Data for as long as necessary to satisfy the purposes for which your Personal Data was collected (as described in Section 4 above) or to comply with applicable legal requirements.
Personal data used to provide you with a personalized experience (see Section 4 above for details) will be kept for a duration permitted by applicable laws.
7. DISCLOSURE, STORAGE AND/OR TRANSFER OF YOUR PERSONAL DATA
We use a variety of reasonable measures (described below) to keep your Personal Data confidential and secure. Please note, however, that these protections do not apply to information you choose to share in public areas such as third party social networks.
People who can access your Personal Data. Your Personal Data will be processed by our authorised staff or agents, on a need to know basis, depending on the specific purposes for which your Personal Data have been collected (e.g. our staff in charge of customer care matters will have access to your customer record).
Measures taken in operating environments. We store your Personal Data in operating environments that use reasonable security measures to prevent unauthorised access. We follow reasonable standards to protect Personal Data. The transmission of information via the Internet is, unfortunately, not completely secure and although We will do our best to protect your Personal Data, We cannot guarantee the security of the data during transmission through our Websites/apps.
Measures We expect you to take. It is important that you also play a role in keeping your Personal Data safe and secure. When signing up for an online account, please be sure to choose an account password that would be difficult for others to guess and never reveal your password to anyone else. You are responsible for keeping this password confidential and for any use of your account. If you use a shared or public computer, never choose to have your login ID/email address or password remembered and make sure to log out of your account every time you leave the computer. You should also make use of any privacy settings or controls We provide you in our Website/app.
Transfer of your Personal Data. The storage as well as the processing of your Personal Data as described above require that your Personal Data are ultimately transferred/transmitted to, and/or stored at, a destination outside of your country of residence, notably Switzerland and Luxembourg. We will also transfer your Personal Data to countries outside the European Economic Area (“EEA”) (e.g. other Nespresso/Nestlé entities or ad-hoc in-country partners) including to countries which have different data protection standards to those which apply in the EEA. We (i) have put in place European Commission approved standard contractual clauses to protect your Personal Data (and you have a right to ask Us for a copy of these clauses(by contacting Us as set out below) and/or (ii) will rely on your consent (where permitted by law).
8.ACCESS TO YOUR PERSONAL DATA
Access to Personal Data. Where provided by law, you, your successors, representatives and/or proxies have the right to access, review and request a physical or electronic copy of information held about you. You also have the right to request information on the source of your Personal Data.
These rights can be exercised by sending a contact form in our site, https://www.Nespresso.com/pt/en/contact-us, or writing to us at Nestlé Portugal Unipessoal, Lda., Divisão Nespresso, Rua Alexandre Herculano, 8, 2799-554 Linda-a-Velha, attaching a copy of your ID or equivalent details (where requested by Us and permitted by law). If the request is submitted by a person other than you, without providing evidence that the request is legitimately made on your behalf, the request will be rejected.
Please note that any identification information provided to Us will only be processed in accordance with, and to the extent permitted by applicable laws.
Additional rights (e.g. modification, deletion of Personal Data). Where provided by law, you, your successors, representatives and/or proxies can (i) request deletion, the portability, correction or revision of your Personal Data; (ii) oppose the data processing; (iii) limit the use and disclosure of your Personal Data; and (iv) revoke consent to any of our data processing activities.
Please note that, in certain circumstances, We will not be able to delete your Personal Data without also deleting your user account. We may be required to retain some of your Personal Data after you have requested deletion, to satisfy our legal or contractual obligations. We may also be permitted by applicable laws to retain some of your Personal Data to satisfy our business needs.
Where available, our Websites have a dedicated feature through which you can review and edit the Personal Data that you have provided. Please note that We require our registered consumers to verify their identity (e.g. login ID/email address, password) before they can access or make changes to their account information. This helps prevent unauthorised access to your account.
We hope that We can satisfy queries you may have about the way we process your Personal Data. However, if you have unresolved concerns you also have the right to complain to competent data protection authorities.

These Terms and Conditions govern the Nespresso&More loyalty program managed by Nestlé Portugal, Unipessoal, Lda. Nespresso Division, headquartered at Rua Alexandre Herculano, 8, 2799-554 Linda-a-Velha. Please read these Terms and Conditions carefully.
This version of the Terms and Conditions came into effect on January 1, 2024.1. What is the Nespresso&More loyalty program?
The Nespresso&More loyalty program is a benefits program for all registered Nespresso customers. Membership is free and automatic upon the first registered valid coffee purchase from Nespresso. The program offers three loyalty levels, with each customer's level determined by their seniority and/or the quantity of capsules purchased during 12 months, starting with the first valid coffee purchase. Purchase implies confirming customer identification on the website www.Nespresso.com, through the app, via the toll-free number 800 260 260, or at Nespresso Boutiques, as proof of the aforementioned requirements. For this purpose, presentation of identification or another sufficient document may be requested.
To benefit from the Nespresso&More loyalty program, you must have had at least 1 valid coffee order in the last 12 months. Legal entities, companies, associations, and other collective entities are eligible and accepted, but only one loyalty membership is available per customer, individual person, legal entity, association, foundation, or similar status. Individuals under the age of 18 are excluded from this benefit.2. How to become a Nespresso&More customer?
By registering on www.Nespresso.com, through the app, via the toll-free number 800 260 260, or at Nespresso Boutiques, you automatically join the Nespresso&More program, thereby accepting these Terms and Conditions, which you should read carefully before registering. To register, we will ask you to provide your contact information.
The use of your personal data is governed by our Privacy Policy, which you should also read carefully. By agreeing to these Terms and Conditions and providing us with your personal information, you agree to the terms of the Privacy Policy.
Your membership in the Nespresso&More loyalty program starts automatically once you successfully fill out the registration form, receive a unique customer number, and make your first valid coffee purchase. You should keep your customer number and password secure, not disclosing them to anyone, as they are personal and non-transferable. You should not allow others to use your registration data and password to access our site. You must immediately notify us of any unauthorized use of your registration data and password or any other security breach of which you become aware. Nespresso cannot be held responsible for any disclosures of your data to third parties under the above conditions.3. Nespresso&More loyalty program levels:
• Connoisseur: The Connoisseur level is assigned to customers with consumption equal to or less than 729 capsules in a 12-month period (1 coffee per day) and/or whose seniority is equal to or less than 4 years.
• Expert: The Expert level is assigned to customers with consumption between 730 and 1094 capsules in a 12-month period (2 coffees per day) and/or whose seniority is equal to or greater than 5 years and less than or equal to 9 years.
If the Expert level is attained based on consumption criteria, the required capsule threshold must be reached every 12 months. Otherwise, your Nespresso&More level will revert to Connoisseur.
• Ambassador: The Ambassador level is assigned to customers with consumption exceeding 1095 capsules in a 12-month period (3 coffees per day) and/or whose seniority is equal to or greater than 10 years.
If the Ambassador level is attained based on consumption criteria, the required capsule threshold must be reached every 12 months. Otherwise, your Nespresso&More level will revert to Expert or Connoisseur.If you do not make valid purchases for a period of 12 months, you will lose your benefits.
To determine program levels, Nespresso uses a calculation method by cross-referencing information between capsule consumption and your seniority as a registered customer. In detail:
• Capsule consumption is calculated between two anniversaries. Your first anniversary refers to the date of your first identified coffee purchase as a Nespresso customer.
• By anniversary, we mean the month (not the day) of your first coffee purchase, which is also the period when benefit renewals occur.
• Seniority means the number of complete periods of 12 months with at least one valid coffee purchase since your first coffee purchase.
• Details of your number of years and capsule consumption can be found in "My Account".
A valid capsule purchase means:
• The number of capsules purchased (invoiced capsules not cancelled within a valid order);
• Both Original and Vertuo capsules are included;
• Free capsules obtained through offers are included;
• Only capsules purchased directly from Nespresso Portugal are included, excluding any purchases made outside the national territory, partners, or resellers.
4. Nespresso&More Benefits
Besides a replacement machine when in need of technical assistance, Nespresso&More customers have access to several benefits according to their loyalty program level.
Benefits for Connoisseur, Expert, and Ambassador
• Free Delivery: Enjoy free delivery on orders over €23,50.
• Descaling Kit Offer: Whenever reaching a consumption of 1000 capsules, the customer can use the code OFERTADESCA in the next order to receive the Descaling Kit as a gift.
Benefits for Expert and Ambassador
• €20 Discount on Accessories: With the purchase of 200 capsules, receive a €20 discount on all Nespresso accessories included in the same order, except accessories from partnerships with brands/personalities external to Nespresso or Nespresso Professional accessories. The total of accessories in the order must exceed €20. Offer valid once a year, between anniversaries, and not cumulative with other promotional campaigns.
• Aeroccino: Offer of a free Aeroccino 3 with the purchase of 300 capsules or an Aeroccino 4 with the purchase of 320 capsules. Offer valid once a year, between anniversaries, limited to 1 Aeroccino per customer, and not cumulative with other campaigns.
Benefits for Ambassador
• Machine: Offer of a Nespresso machine with the purchase of a specific quantity of capsules.
Original Nespresso System Machines
With the purchase of 400 capsules choose any from the Essenza Mini Range.
With the purchase of 450 capsules from the Pixie Range.
With the purchase of 470 capsules from the Citiz Range or Essenza Mini Pack + Aeroccino 3.
With the purchase of 500 capsules choose another model from the Original System (except Barista), with a €189 discount, paying the price difference.
Offer valid once a year, between customer account anniversaries, limited to 1 machine per customer, and not cumulative with other promotional campaigns.
Vertuo Nespresso System Machines
With the purchase of 500 capsules choose any from the POP Range.
With the purchase of 600 capsules choose another model from the Vertuo System, with a €159 discount, paying the price difference.
Offer valid once a year, between customer account anniversaries, limited to 1 machine per customer, and not cumulative with other promotional campaigns.
All benefits are subject to stock availability and may be replaced by others in case of out of stock, subject to agreement with the Customer.
It is expressly regulated here that the Machine, Aeroccino, and €20 Discount on Accessories benefits are not cumulative in the same purchase, among themselves, or among other ongoing promotional campaigns, except when explicitly stated that the campaigns are cumulative. Their use is made through the purchase of the corresponding quantity of capsules.

You may cancel your registration at any time by contacting Nespresso by mail at Rua Alexandre Herculano, 8, 2799-554 Linda-a-Velha, through our contact form available at www.Nespresso.com/pt/en/contact-us, or via the toll-free phone number 800 260 206. In this case, upon cancellation request, your personal data, customer registration, and purchase history will be deleted, thus losing your level for program benefit purposes.
Nespresso reserves the right to freely change or cancel the Nespresso&More benefits program without prior notice or compensation to the Customer.
Nespresso reserves the right to cancel your registration by written notice in case of breach of these Terms and Conditions or in the event of abusive use or resort to fraudulent methods to use the benefits.
To the fullest extent permitted by law, Nespresso shall not be liable for any losses, damages, and costs (whether direct, indirect, consequential, or otherwise) arising directly or indirectly from your membership, Benefits, or your use of any material contained on the website, including but not limited to any acts or omissions, whether such claims for loss or damage arise from our negligence or not.
Nespresso does not exclude liability to you for:
(a) death or personal injury caused by our negligence; or
(b) our fraudulent misrepresentation.
If any provision of these Terms and Conditions is or becomes, for any reason, invalid, illegal, or unenforceable, it shall be immediately disregarded from these Terms and Conditions, without affecting the validity of the remaining provisions.
6. Entire Agreement
These Terms and Conditions, along with the Privacy Policy, constitute the entire agreement between you and Nespresso regarding the Nespresso&More loyalty program, meaning that you cannot claim that we have made statements or warranties beyond those contained in these Terms and Conditions and the aforementioned Terms and Conditions.
7. Law and Jurisdiction
These Terms and Conditions are governed and interpreted in accordance with Portuguese law. All disputes or claims arising out of or in connection with these Terms and Conditions (including non-contractual disputes or claims) shall be subject to the jurisdiction of the Oeiras district court.

1. Applicability
1.1. These Terms and Conditions regulate “My Plan Nespresso”, hereinafter referred as PLAN.
1.2. The PLAN chosen is executed between yourself and Nestlé Portugal, Unipessoal, Lda. – Nespresso Division (Nespresso), with head offices at Rua Alexandre Herculano, 8, 2799-554 Linda-a-Velha, legal person no. 500.201.307, registered at the Commercial Registry Office of Cascais.
1.3. By choosing the PLAN you accept these Terms and Conditions.
1.4. The PLAN can only be executed by natural persons, over 18 years of age, residing at Portugal and legal persons with head offices in Portugal. Each natural or legal person can only have one PLAN, choosing between a Machine or Coffee plan, that is, you can only subscribe to a second PLAN after the first one has been terminated/is no longer active.
1.5. Consumers or companies wishing to benefit from the PLAN must be registered as Nespresso customers. Should they not be registered, they must do so through the website www.Nespresso.com/pt/pt, through the Customer Relationship Centre available on the toll-free number 800 260 260 or at any Nespresso Boutique.2. Payment Methods
2.1. Online Subscription (Ecommerce):
2.1.1. Should you conclude your PLAN through the Nespresso website, monthly instalments shall be paid exclusively through a bank card stipulated for this purpose, and payments shall be deducted from said card monthly during the term of the PLAN.
2.1.1.1. The respective card must have permissions for international and recurring payments.
2.1.1.2. If it is a virtual credit card, the amount must be greater than the monthly fee paid.
2.1.2. The first instalment shall be paid upon purchase of the PLAN and will be completely reversed into credit and made available in the customer's account within a maximum period of 2 (two) business days, after invoicing.
2.1.3. To ensure that your bank card is not being used without your consent, we reserve the right to confirm, in our databases and from third-party, name, address and other personal information supplied by you during the order process.
2.1.4. No changes to the payment mode mentioned in 2.1.1 can be made during the term of the PLAN, except in exceptional situations upon approval by Nespresso.
2.1.5. Bank card information should be updated whenever necessary by the Customer.
2.2. Subscription at Nespresso Boutiques:
2.2.1. Should you conclude your machine PLAN at Nespresso Boutiques, monthly instalments can be paid through the following payment modes:
a) Direct debit, and for this purpose you must formalize the acceptance of these Terms and Conditions, provide your bank details, as well as a corresponding proof and direct debit authorization. The first monthly fee is €1 (except for the Creatista Plus model, available for €120 (one hundred and twenty euros), and for the Creatista Pro and Vertuo Creatista models, available for €240 (two hundred and forty euros), respectively)) paid upon purchase and the following by direct debit;
b) Bank card, through the sales terminals, where to ensure the security of the transactions and that your bank card is not being used without your consent, the record of the card for the recurrent payments is made automatically during the payment of the first instalment. To confirm the operation, it is also necessary formalize the acceptance of these Terms and Conditions.
2.2.2. The details of the PLAN holder must match the bank details provided for payment of the monthly fee.
2.2.3. The first instalment of the PLAN will be paid upon purchase of the PLAN, immediately reversed into credit in the customer's account. The remaining instalments shall be deducted monthly on a recurring date and to be defined at the time of subscribing the PLAN, from the above-mentioned account or bank card, indicated in 2.2.1..
2.2.4. The credit for your subsequent monthly payments may take up to 4 business days to be available in your customer account.
2.2.5. Changing the payment method referred to in 2.2.1 is not permitted. during the term of the PLAN, except in exceptional situations with the approval of Nespresso.
2.2.6. In the case of payment by direct debit, the request to change the bank account must be made exclusively through the toll free number 800 260 260 or through the form available at https://www.Nespresso.com/pt/pt/contact-us.
2.2.7. In the case of payment by bank card, the bank card change must be made through your account at www.Nespresso.com/pt/en or the toll free number 800 260 260.3. Use of Credits
3.1. The monthly instalments paid for the PLAN, during the term, shall be credited to your Nespresso Customer account. redited to your Nespresso Customer account.
3.2. The receivable credit is debited monthly, in the account or bank card, on a recurring date and to be defined at the time of subscribing the PLAN, and the availability can occur up to 4 working days after the payment.
3.3. The credit available (in an amount equal to the instalments paid by the Customer) can be used to purchase Nespresso capsules and other products (excluding any Limited Editions to be defined at any time or Acquisition of Machine in campaign) through the following Nespresso sales channels:
a) Online through the website www.Nespresso.com/pt/en;
b) Online through the Nespresso App;
c) At Nespresso Boutiques;
d) Customer Relationship Centre available on the toll-free number 800 260 260.
3.4. The credit is non-refundable and non-transferable and may not be exchanged for a cash equivalent, and must be used by the customer for his benefit within the period provided for that purpose.
3.5. Should you not use the available credit in the month in which it is made available, the corresponding credit amount shall accrue to the credit of the following month, and so on; unused credit amounts shall remain available up to 2 years from the termination date of the PLAN (except in cases of non-compliance or early termination).
3.6. Any credit remaining after the above-mentioned time period, or regardless of the time period, in cases of non-compliance or early termination of the PLAN, shall expire and the Customer shall not receive any refund.
3.7. The Customer can check their current credit balance by accessing their account at www.Nespresso.com/pt/en.
3.8. The Customer cannot use any available credit coming from the PLAN on his Nespresso Customer account to pay monthly instalments of the current PLAN or subscribe a new one.4. Cooling Off Period (exclusive for online Subscriptions (eCommerce))
4.1. Should you have concluded this PLAN outside our Boutiques, through the www.Nespresso.com/pt/en website, you have the right to freely terminate your PLAN, without giving any reason, within 14 days after you have received the selected Nespresso coffee machine - during the so-called “Cooling off Period”.
4.2. To exercise your right to free termination of the PLAN, you must communicate your decision by means of a clear, written statement during the 14-day deadline. You can use the Chat or “Contact Us” option on the website available at https://www.Nespresso.com/pt/en/contact-us, or through letter to Nespresso Customer Service, Rua Alexandre Herculano, 8, 2799-554 Linda-a-Velha.
4.3. You must return or deliver us the Nespresso coffee machine, or that were shipped during the notification period when you notified us of your wish to exercise your termination right. For this purpose, contact our Customer Relationship Centre on 800 260 260 to schedule the collection.
4.4. Nespresso will only accept returns of products in their original condition and packaging, accompanied by the respective invoice.
4.5. By exercising the right to free termination within the 14-day deadline set in clause 4.1. above, we shall reimburse you all payments made, including shipping expenses.
4.6. The reimbursement shall be made using the same payment method used in the purchase, no later than 14 days after we receive the Nespresso coffee machine and any capsules and/or accessories you have returned to us. You shall bear no charges with this reimbursement.
4.7. Should you terminate your contract before receiving the Nespresso coffee machine, any capsules and/or accessories, we shall refund you within 14 days from the date when the return service was registered. We may retain the reimbursement until we receive the Nespresso coffee machine.5. Early termination and Breach of contract
5.1. Should you wish to terminate your PLAN before the end of the term, you can do so by means of a clear, written statement, through the Chat or “Contact Us” option on the website available at https://www.Nespresso.com/pt/en/contact-us, or through letter to Nespresso Customer Service, Rua Alexandre Herculano, 8, 2799-554 Linda-a-Velha.6. 7.1. The PLAN is limited to the existing stock.
7.2. The PLAN is not transferable between distinct Nespresso accounts.
7.3. Nespresso may change the PLAN terms and conditions at any time by means of publication at www.Nespresso.com/pt/en, which must be consulted periodically by the Customer, without prejudice to changes whose communication is legally obligatory.
7.4. Nespresso has the right to cancel the PLAN at any time, namely, and without limitation, in situations or attempts identified by Nespresso as fraudulent, as well as any acts or omissions that prove harmful to Nespresso.
7.5. PLANS subscribed online (eCommerce) shall also be governed by the remaining remote sales conditions available at www.Nespresso.com/en in everything that do not conflict with these conditions.
7.6. These conditions are governed by Portuguese law, with exclusive competence by the Oeiras jurisdiction in case of dispute.
7.7. In case of dispute, you may, as an alternative, use an Alternative Dispute Resolution Body available at www.consumidor.pt. -
1. “My Plan Nespresso”
1.1. This PLAN consists of the purchase of a Nespresso machine from the models available for €1 (one euro), except for the Creatista Plus model, available for €120 (one hundred and twenty euros), and for the Creatista Pro and Vertuo Creatista models, available for €240 (two hundred and forty euros).
1.2. To purchase the machine at the price referred to in the previous point, the customer undertakes a payment of a fixed monthly instalment, the amount of which shall depend on the selected machine model, during a 12- or 18-month period. The monthly fixed instalment shall be completely reversed into credit available for use when buying Nespresso coffee and products.
1.3. The PLAN can be purchased with Nespresso through the following channels:
a) online through the website www.Nespresso.com/pt/en;
b) at Nespresso Boutiques.2. Contract Term
2.1. The PLAN shall have a 12- or 18- month term from the date of its execution.
2.2. The PLAN ends automatically at the end of the chosen period, without prejudice the accumulated credit, as established in clause 3 (3. Use of Credits).
2.3. The end of the PLAN does not affect any unused credit amounts, that shall remain available for use by the Customer up to 2 years from the termination date of the PLAN.
2.4. The cancellation of the PLAN before the expiry of the term presupposes the payment of the cancellation fee corresponding to the selected machine, deducted from any credits that you have in your customer account. The amount of the cancellation fee will not be converted into credit.
2.5. The previous number does not apply if you exercise the right of free termination, as established in clause 4.
2.6. In the event of non-payment of the monthly fee on the due date, Nespresso will block access to your Nespresso account and your credit until payment is made or until the cancellation fee is issued.
2.7. If payment remains pending 60 days after the due date of the monthly fee, Nespresso may terminate the PLAN with just cause, with the penalties provided for in clause 2.4. being applicable, as well as all unused credits having expired. -
1. “My Plan Nespresso”
1.1. This PLAN consists of the purchase of a Refurbished Nespresso machine from the models available for €1 (one euro), except for the Creatista Plus and Creatista Pro models, available for €70 (seventy euros) and €90 (ninety euros), respectively.
1.2. To purchase the machine at the price referred to in the previous point, the customer undertakes a payment of a fixed monthly instalment, the amount of which shall depend on the selected machine model, during a 12- or 18-month period. 2.4. The cancellation of the PLAN before the expiry of the term presupposes the payment of the cancellation fee corresponding to the selected machine, deducted from any credits that you have in your customer account. The amount of the cancellation fee will not be converted into credit.
2.5. The previous number does not apply if you exercise the right of free termination, as established in clause 4.
2.6. In the event of non-payment of the monthly fee on the due date, Nespresso will block access to your Nespresso account and your credit until payment is made or until the cancellation fee is issued.
2.7. If payment remains pending 60 days after the due date of the monthly fee, Nespresso may terminate the PLAN with just cause, with the penalties provided for in clause 2.4. being applicable, as well as all unused credits having expired. -

1.1. This PLAN consists of the purchase of a Nespresso machine from the models available for €1 (one euro), two surprise boxes, direct entry to the top level (Ambassador) of the loyalty campaign (Nespresso & More) and other personalized services.
1.2. To purchase the machine at the price referred to in the previous point, the customer undertakes a upon payment of a fixed monthly instalment, the amount of which shall depend on the selected machine model. The monthly fixed instalment shall be completely reversed into credit available for use when buying Nespresso coffee and products.

At the end of the initial period of 12 months, your PLAN will also include the offer of 20 (twenty) Nespresso coffee capsules, from the permanent Original or Vertuo line range (excluding Limited Editions, Special Reserves, Seasonal Editions, Craft Brew or others that may be defined at any time) whenever it reaches 180 (one hundred and eighty) capsules, in a single or several purchases, without changing the value of your fixed monthly fee, or loyalty. 2.3. Offer limited to 1 200 (one thousand and two hundred) capsules per year. Offer accumulates with any purchase, the offer being valid only on purchases at Nespresso Boutiques and Customer Service via the toll-free number 800 260 260.
2.4. After the initial period of validity of 12 months of the PLAN and if you maintain unused credit, it will remain available for use for a period of 2 (two) years, except for the situations provided for in number 6 of these Terms and Conditions.
2.5. The cancellation of the PLAN before the expiry of the term presupposes the payment of the cancellation fee corresponding to the selected machine, deducted from any credits that you have in your customer account. The amount of the cancellation fee will not be converted into credit.

1. When you deliver your used machine, you will donate a machine to Nespresso so that we can give it a Second Life;
2. The delivery of the machine will not have any financial compensation on, and Nespresso may refurbish and market the machine under the RELOVE program;
3. According to the criteria established by Nespresso, if it is not possible to recover the machine, Nespresso will send the machine for recycling. -
1. What are the Nespresso Welcome Offers?
The Nespresso Welcome Offers are several exclusive offers for new customers who meet the necessary requirements, specifically, customers up to 12 months from the first coffee order. The purpose of this program is to accompany the new customer on their journey through the Nespresso world, giving them the opportunity to experience and explore our range of coffees and accessories. These offers are automatically active, on the customer's 1st order, and can benefit from them in orders placed in our Boutiques and online store. These offers are cumulative with current campaigns.2. What are the offers?
Over the course of 12 months, Nespresso will present different offers that the customer will be able to choose, if they meet the requirements indicated in the next paragraph, receiving the current offer with their coffee order.
